Definition: This block contains a wide variety of disorders that differ in severity and clinical form but that are all attributable to the use of one or more psychoactive substances, which may or may not have been medically prescribed. The third character of the code identifies the substance involved, and the fourth character specifies the clinical state. The Commission should be empowered to adopt delegated acts in accordance with Article 290 TFEU in order to determine the rules for the calculation of the interest rate to be applied in the event of a decision on the recovery of misused amounts from the Fund and to guarantee the rights to good administration and of access to documents of beneficiaries in procedures in respect of such a recovery; determine the type of contributions to the Fund and the matters for which contributions are due, and the manner in which the amount of the contributions is calculated and the way in which they are to be paid; specify registration, accounting, reporting and other rules necessary to ensure that the contributions are paid fully and in a timely manner; determine the annual contributions necessary to cover the administrative expenditure of the Board before it becomes fully operational; determine the contribution system for institutions that have been authorised to operate after the Fund has reached its target level; determine the criteria for the spreading out in time of the contributions; determine the criteria for determining the number of years by which the initial period for reaching the target level can be extended; determine the criteria for establishing the annual contributions when the available financial means of the Fund diminishes below its target level after the initial period; determine the measures to specify the circumstances and conditions under which ex-post contributions may be temporarily deferred for individual institutions; and determine the detailed rules for the administration of the Fund and general principles and criteria for its investment strategy.

There is no EU legislation on the aquaculture sector at present, and it continues to be covered by a plethora of EU legislation and national rules which can vary significantly between states, creating a legal framework lacking in transparency and discriminatory situations and market distortions that do little to encourage investment in the sector. The Commission adopted an initial communication in 2002, which was the subject of a European Parliament legislative resolution of January 2003, has failed to increase the transparency of the regulatory framework. On the contrary, the Commission and Council have continued to adopt, often via the comitology procedure, detailed rules applicable to aquaculture (organic and otherwise), in respect of which Parliament has had no opportunity whatsoever to voice a direct opinion. The recent Commission communication of April 2009 which forms the subject of this report therefore provides the chance to assess the appropriateness of introducing a specific EU framework for the aquaculture sector, with the ultimate objective remaining the structured development of a sustainable European aquaculture industry which respects environmental balances, increases the economic worth of aquaculture operators and their local communities and offers consumers more guarantees.

Indeed, throughout this period it has not produced a single new initiative of any real significance, with the result that it has moved from being a driving force in this field to becoming a hindrance to the bi-regional strategic partnership, disassociating itself from the European Parliament, which should have continued to be its traditional ally in formulating the Union’s policy towards the sub-continent. How else are we to explain the cuts which the Commission has made year after year in its budgetary initiatives for Latin America, which have been restored only after substantial efforts on the part of Parliament?

What we now need is not more words, but action; and action which hopefully does not end up like the ‘Everything but Arms’ initiative in which the Commission produced a fine proposal which, unfortunately, was completely destroyed by the Council which postponed the agreement on rice, sugar and bananas until the year 2009.

What such initiatives cannot do, and this is what concerns Parliament, is to make up for the inconsistencies between the Member States which lead to such a legislative mire, with each Member State doing its own thing with initiatives to suit its own taste, without a genuine Community vision and ignoring their joint responsibility. They are also overlooking the need for a serious and coherent body of legislation, which the Commission is proving it is possible to achieve – and I am looking at Commissioner Vitorino now – in one of the most sensitive areas. That area is a model for coexistence in Europe and the fundamental freedoms associated with it, in this case freedom of the individual.

It is a widespread concern in this regard: I therefore call upon you to initiate a final debate, no longer on roles so much as on the political content of Parliament and the Commission’s initiative: definite, clear-cut choices which describe a Europe in which the memory of the cucumbers – to which President Prodi referred – is increasingly faint and remote.
