However, that statement fails to take into account the fact that, pursuant to that same case-law, ‘Provisions which, even if they are applicable without distinction, preclude or deter a national of a Member State from leaving his country of origin in order to exercise his right to freedom of movement therefore constitute an obstacle to that freedom’.
