IN-CONTEXT TRANSLATIONS

(3) This section applies, and section 45 does not apply, to agreements and arrangements and to provisions of agreements and arrangements between or among teams and clubs engaged in professional sport as members of the same league and between or among directors, officers or employees of those teams and clubs where the agreements, arrangements and provisions relate exclusively to matters described in subsection (1) or to the granting and operation of franchises in the league, and section 45 applies and this section does not apply to all other agreements, arrangements and provisions thereof between or among those teams, clubs and persons.

2. Any information furnished by virtue of paragraph 1 shall be used only for the purposes of applying this Agreement and the legislation to which this Agreement applies and for no other purpose.

Pending its entry into force, the Agreement shall be applied on a provisional basis by the Union and by the Member States from the first day of the month following the earliest of: (i) the date of the last note by which the Contracting Parties notify each other of the completion of the procedures necessary to provisionally apply the Agreement, or (ii) subject to the internal procedures and/or domestic legislation, as applicable, of the Contracting Parties, the date that falls 12 months from the date of signature of the Agreement.

(5) Whereas Directive 98/34/EC is not intended to apply to national rules relating to fundamental rights, such as constitutional provisions concerning freedom of expression and, more particularly, freedom of the press; whereas it is not intended to apply to the general criminal law either; whereas, furthermore, it does not apply to agreements governed by private law between credit institutions, in particular, to agreements on the execution of payments between credit institutions;

Whereas under Article 7 of Council Regulation No 17 (2), the prohibition laid down in Article 85 (1) of the Treaty applies only for the period fixed by the Commission in respect of agreements, decisions and concerted practices already in existence at the date of entry into force of that Regulation if they have been notified to the Commission within the prescribed time limits and if the undertakings and associations of undertakings concerned cease to give effect to them or make appropriate amendments to them ; whereas this provision also applies to agreements, decisions and concerted practices already in existence at the date of entry into force of the said Regulation and falling within Article 4 (2) thereof, if they were notified before 1 January 1964;
