(3) Every person who applies, or causes the application of, a new approved tag to an animal, or the carcass of an animal, that already bears an approved tag or an approved tag that has been revoked shall, within 30 days after the new approved tag is applied, report to the responsible administrator the number of the new approved tag as well as the number of the previously applied tag.

184 (1) Subject to subsections (2) and (3), if an animal that is required to bear an approved tag does not bear an approved tag, bears an approved tag that has been revoked or loses its approved tag, the person who owns or has the possession, care or control of the animal shall immediately apply a new approved tag to it.

(3) When considering the revocation of an approved tag, chip or other indicator, the Minister shall take into account whether there is any other tag, chip or other indicator that offers improved performance over that approved tag, chip or other indicator with respect to the criteria set out in paragraphs (2)(b) to (e).

2. By way of derogation from Article 4(5) of Regulation (EC) No 1760/2000, where the animals are moved to the premises, the approved ear tags may be removed from the animals without permission of the competent authority but under its the control, provided that, at the latest when the approved ear tags are removed, the animals are marked by the means of identification chosen by the competent authority as provided for in Article 3(1) of this Regulation.
2. Par dérogation à l’article 4, paragraphe 5, du règlement (CE) no 1760/2000, lorsque les animaux sont déplacés vers les locaux, les marques auriculaires approuvées peuvent être enlevées aux animaux sans l’autorisation de l’autorité compétente mais sous son contrôle à condition que, au plus tard lorsque les marques auriculaires seront retirées, les animaux soient marqués par les moyens d’identification choisis par l’autorité compétente comme le prévoit l’article 3, paragraphe 1, du présent règlement.

1. The keeper of the animals shall, at all times, be in possession of the two ear tags approved by the competent authority in accordance with the first subparagraph of Article 4(1) of Regulation (EC) No 1760/2000 (‘the approved ear tags’).

In particular, it provides that all animals on a holding born after 31 December 1997 or intended for intra-Community trade after 1 January 1998 and, for animals on a holding in the Czech Republic, Estonia, Cyprus, Latvia, Lithuania, Hungary, Malta, Poland, Slovenia or Slovakia, born by the date of accession or intended for intra-Community trade after that date, that such animals shall be identified by an ear tag approved by the competent authority, applied to each ear (‘approved ear tags’).

By way of derogation from Regulation (EC) No 1760/2000, it is appropriate to provide that the approved ear tags may be removed without the permission of the competent authority, but under its control, after animals are moved to the premises and that such ear tags not need to be applied to animals born on such premises.

The special identification system should, in accordance with Regulation (EC) No 1760/2000, provide for derogations only from the application and removal of the approved ear tags.
