Acknowledges the need for further progress in the area of contract law and favours, amongst other options, the option 4 of setting up an optional instrument (OI) by means of a regulation; after an impact assessment and clarification of the legal basis; believes that such an OI could be complemented by a ‘toolbox’ that could be endorsed by means of an interinstitutional agreement; calls for the creation of ‘European standard contract models’, translated into all EU languages, linked to an ADR system carried out online, which would have the advantage of being a cost-effective and simpler solution for both contractual parties and the Commission;

Notes that the role of CCS under the ETS will be addressed in the review of the ETS after 2012; notes, however, that some commercial CCS projects may become operational before 2012, including projects in Member States and in Norway, which will be linked to the ETS through the Agreement on the European Economic Area (EEA Agreement) from 1 January 2008; calls on the Working Group on the ETS to examine to what extent CCS could be recognised within the ETS, having regard to the need for comparable treatment of low or non-CO2 emitting activities and the need for a level playing field both between various CCS options and across the EU for investment in CCS technologies;

Ferry Services, B.C. Rail Ltd and B.C. Transportation and Financing Authority: (a) how many acres (or hectares) of farm land will be used for Roberts Bank port and rail related developments now underway or under study; (b) with the completion of the Roberts Bank port expansion, including both the third berth and second terminal, what plans, if any, are there to use the Brunswick Point farmlands; (c) is the affected Roberts Bank farmland presently protected by the B.C. Agricultural Land Reserve designation; (d) does the Tsawwassen Final Agreement address the issue of farmland protection and if so, how; (e) will the farmland continue to be protected by the Agricultural Land Reserve designation following ratification of the Tsawwassen Final Agreement and, if not, why; (f) did the Vancouver Port Authority undertake to work jointly with the Tsawwassen Band to ensure the removal of the Agricultural Land Reserve designation from the farmland and, if so, why and what alternate measures did it put in place to protect farmland adjacent to the Roberts Bank port, rail and highway expansion; (g) did the Vancouver Port Authority agree to jointly develop with the Tsawwassen Band a container handling facility on the farmland protected by the B.C. Agricultural Land Reserve designation and, if so, why did the Vancouver Port Authority enter into such an agreement rather than develop container handling facilities further inland in a less environmentally sensitive area; (h) did the Vancouver Port Authority agree that the land would be leased at lease rates ...

49. Calls on the Commission to further explore the various options for the next generation of broad-scope agreements with the southern ENP countries; stresses that those agreements must include provision for arrangements to implement the human rights clause; notes that those bilateral agreements should not be at the expense of furthering multilateral cooperation in the region, and in particular the pursuit of the Barcelona Process goals, including the creation of a free trade area; calls on the Member States to reflect on possible ways of strengthening cooperation, including by means of increased flexibility in opening agricultural and labour markets in the future, in ways compatible with social protection and equity; calls on the Southern ENP countries to redouble their efforts to open economic systems to a greater extent and to harmonise their economic rules with the relevant parts of the EU acquis ; stresses the need to grant Mediterranean countries the right to control the pace at which their markets are opened up and their national economic and social development strategies; considers that more effective use of the ENPI for regional projects would make it possible to improve the situation so as to promote a genuinely integrated regional economic area;

I have said quite clearly that the Agreement recommends that a separate agreement be negotiated for this area, and I believe that this should go much further in taking Parliament's rights into account. Mrs Hautala is right to say that, if this does not succeed, one of the options provided is that of an appeal.

The Commission puts forward four options which can be summarized as follows: the maintenance of the status quo, with certain adjustments; the introduction of an overall framework agreement backed by bilateral agreements, the splitting-up of the Lomé Convention into regional agreements; finally, a specific agreement with the least developed countries (LDCs) in the ACP area which would possibly be open to other LDCs.
