Where Union legislation on official controls already provides for specific official controls at border entities, as in accordance with Regulation (EC) No 882/2004, Directives 91/496/EEC and 97/78/EC or points of entry in accordance with Directive 2000/29/EC, for categories of goods referred to in paragraph 1 of this Article, Member States shall confer the responsibility of performing the controls referred to in paragraph 2 of this Article to the competent authorities tasked with those controls in accordance with Article 4 of Regulation (EC) No 882/2004 or in Article 2(1)(g) of Directive 2000/29/EC.

At trade fairs, exhibitions and demonstrations for the marketing of pyrotechnic articles, Member States shall not prevent the showing and use of pyrotechnic articles not in conformity with this Directive, provided that a visible sign clearly indicates the name and date of the trade fair, exhibition or demonstration in question and the non-conformity and non-availability for sale of the pyrotechnic articles until brought into conformity.

Lors de foires commerciales, d’expositions et de démonstrations organisées pour commercialiser des articles pyrotechniques, les États membres ne s’opposent pas à la présentation et à l’utilisation d’articles pyrotechniques non conformes à la présente directive, à condition qu’une marque visible indique clairement le nom et la date de la foire commerciale, de l’exposition ou de la démonstration en question, ainsi que la non-conformité et la non-disponibilité à la vente des articles pyrotechniques tant qu’ils n’auront pas été mis en conformité.

4. For the prosecution of any of the offences referred to in Article 3(3), (4) and (5), Article 4(2), (9), (9b), (9c) and (9d), and Article 5(6) committed outside the territory of the State concerned, as regards paragraph 1(b) of this Article, Member States shall take the necessary measures to ensure that its jurisdiction is not subordinated to the condition that the acts are a criminal offence at the place where they were performed.

At trade fairs, exhibitions and demonstrations for the marketing of pyrotechnic articles , Member States shall not prevent the showing and use of pyrotechnic articles not in conformity with the provisions of this Directive, provided that a visible sign clearly indicates the name and date of the trade fair, exhibition or demonstration in question and the non-conformity and non-availability for sale of the articles until brought into conformity by the manufacturer, where such manufacturer is established within the Community, or by the importer .

Without prejudice to paragraph 3 of this Article and to Article 5(3) of this Regulation, where, in a Member State, applications for import licences for sugar for refining for a marketing year, with the exception of applications without reduction of the full rate of duty applicable to import, are equal to or greater than the limit referred to in paragraph 1 of this Article, Member States shall inform the Commission that they have reached the limit of their traditional supply needs for import and, where appropriate, shall fix an allocation coefficient in proportion to the quantity available to apply to each licence application for sugar for refining for the current week.

For the purposes of applying Article 6(4) of Directive 2003/6/EC, and without prejudice to the right of Member States to provide for other notification obligations than those covered by that Article, Member States shall ensure that all transactions related to shares admitted to trading on a regulated market, or to derivatives or other financial instruments linked to them, conducted on the own account of persons referred to in Article 1 points 1 and 2 above, are notified to the competent authorities.
