As noted above, the Court held in Kyrian that‘the first stage’ of enforcement in the context of mutual assistance is, notification to the addressee by the requested authority of all instruments and decisions which emanate from the Member State in which the applicant authority is situated and which relate to a claim and/or its recovery, the notification having to be carried out on the basis of information supplied by the applicant authority As will be illustrated below, the same must necessarily apply when a Member States attempts to notify a claim without the assistance of a requested authority, as is the case in the main proceedings.

Many say that while the region remains the appropriate level for the conception and management of assistance for the above reasons, designating eligible areas at the sub-regional level can artificially restrict the field of intervention of Community assistance, and is difficult to reconcile with an approach emphasising the new factors of competitiveness.

(d) Where the financing needs of the beneficiary decrease fundamentally during the period of disbursement of the macro-financial assistance compared to the initial projections, the Commission should, in accordance with the advisory procedure where the assistance is equal to or below EUR 90 million, and in accordance with the examination procedure where the assistance is above EUR 90 million, reduce the amount of such assistance or suspend or cancel it.

(c) Following the adoption of the decision granting macro-financial assistance, the Commission, acting in accordance with the advisory procedure where the assistance is equal to or below EUR 90 million, and in accordance with the examination procedure where the assistance is above EUR 90 million, should agree with the beneficiary, in the Memorandum of Understanding, on the policy measures referred to in points 6(c), (d), (e) and (f).

The Commission should play a leading role in this process, paying particular attention to requests for technical assistance and, above all, presenting a strategy that includes the defence of human rights, the right to education and training, culture, employment, sports, adequate housing, healthcare and better sanitation for the Roma population as priority areas.
