request that the Belarusian authorities implement Decision A/HRC/WGAD/2012/39 of the United Nations Working Group on Arbitrary Detention on the case of human rights defender Ales Bialiatski, which found in particular that the detention of Mr Bialiatski, President of the Viasna Human Rights Centre and International Federation for Human Rights (FIDH) Vice-President, was arbitrary, ‘being in contravention of Article 20, paragraph 1, of the Universal Declaration on Human Rights (UDHR) and Article 22 of the International Covenant on Civil and Political Rights’ (ICCPR);
demander aux autorités biélorusses de mettre en œuvre la décision A/HRC/WGAD/2012/39 du groupe de travail des Nations unies sur la détention arbitraire concernant le cas du défenseur des droits de l'homme Ales Bialiatski, cette décision ayant notamment conclu que la détention de M. Ales Bialiatski—a human rights activist, vice-president of the International Federation for Human Rights, and head of the Human Rights Center “Viasna”—was sentenced to four and a half years of imprisonment just several days ago, because Lithuania and Poland gave Belarusian authorities his private bank accounts, which he used, for example, to collect money for legal support of imprisoned people.
Ales Bialiatski — activiste des droits de la personne, vice-président de la Fédération internationale des droits de l’Homme et président de l’organisme des droits de la personne Viasna — a été condamné à quatre ans et demi de prison il y a quelques jours à peine parce que la Lituanie et la Pologne ont communiqué ses coordonnées bancaires aux autorités biélorusses.

47. Remains extremely concerned at the lack of democracy, rule of law, fundamental freedoms and the respect for human rights in Belarus, the only European Neighbourhood country not to fully participate in the Eastern Partnership and the work of the Euronest Parliamentary Assembly, especially in the aftermath of the presidential elections in December 2010 and the subsequent violent crackdown on protesters and political opposition, including trials of activists in 2011 which did not conform to international standards and saw disproportionately harsh sentences handed down; commends the EU’s unity in response to the expulsion of EU diplomats from Belarus in February 2012; urges the Union and all of its Member States to remain coherent and consistent in their policies towards Belarus, and to keep up the pressure on the political regime, including through sanctions, among others against enlisted officials, while reaching out to civil society through such tools as enhanced visa facilitation and increased education, training and other exchange opportunities; expresses strong concern over Ales Bialiatski’s imprisonment since 4 August 2011; regrets the actions of the Polish and Lithuanian officials who allowed Ales Bialiatski to be arrested through the forwarding of banking information, and calls for utmost efforts by all actors in the EU to prevent a repetition of such mistakes;
47. demeure extrêmement préoccupé par l'absence de démocratie, d'état de droit, de libertés fondamentales et de respect des droits de l'homme en Biélorussie, seul pays voisin de l'Union qui ne participe pas pleinement au Partenariat oriental ni aux travaux de l'Assemblée parlementaire Euronest, notamment à la suite des élections présidentielles de décembre 2010 et à la violente répression qui s'en est suivie à l'encontre des protestataires et de l'opposition politique, y compris les procès d'militants en 2011 qui n'ont pas respecté les normes internationales et ont abouti à des peines d'une sévérité disproportionnée; salue la réponse unie de l'Union à l'expulsion de diplomates européens de Biélorussie en février 2012; prie instamment l'Union et tous ses États membres de rester cohérents et logiques dans leurs politiques à l'égard de la Biélorussie et de maintenir la pression sur le régime politique, y compris au moyen de sanctions contre les officiels impliqués, tout en restant à l'écoute de la société civile grâce à des outils tels que la simplification accrue de la délivrance de visas et l'augmentation des possibilités en matière d'enseignement, de formation et d'autres possibilités d'échanges; exprime sa profonde inquiétude concernant Ales Bialiatski, emprisonné depuis le 4 août 2011; regrette les actions des responsables polonais et lituaniens, qui ont permis l'arrestation d'Ales Bialetski grâce à la transmission d'informations bancaires au gouvernement biélorusse, et demande que tous les acteurs de l'Union mettent tout en œuvre pour éviter que de telles erreurs ne se reproduisent;

D. whereas on 16 August 2011 a district judge in Minsk rejected an application from Ales Bialiatski's lawyer for the human rights defender to be released on his own recognisance, and whereas the period of Ales Bialiatski's pre-trial detention had been extended to two months earlier that week;

B. whereas human rights defender Ales Bialiatski, Chair of the ‘Viasna’ Human Rights Centre and Vice-President of the International Federation for Human Rights (FIDH), after being held at the detention centre of the Belarusian Interior Ministry, was arrested in Minsk on 4 August 2011 on the formal charge of large-scale tax evasion (‘concealment of profits on a particularly large scale’) and indicted on 12 August 2011 under Part II of Article 243 of the Belarusian Criminal Code; whereas he faces a penalty of either up to five years' ‘restricted freedom’ or three to seven years' imprisonment and the confiscation of his assets, including the premises from which ‘Viasna’ is run;
