Third, that the Council decision and the Council Regulations amount to a breach of the applicant’s fundamental rights as protected by the EU Charter of Fundamental Rights and/or the European Convention of human Rights including the applicant’s right to human dignity, right to a good administration, right to an effective remedy and a fair trial, right to be presumed innocent and rights of defence, right to respect for his private and family life, home and communications, freedom to conduct a business, and his right to property.

Calls on the European Union, the Member States and the US authorities to investigate and provide full clarification about the abuses and violations of international and national law on human rights, fundamental freedoms, the prohibition of torture and ill-treatment, enforced disappearance and the right to a fair trial committed in connection with the 'war against terror', so as to establish responsibility for secret detention centres - including Guantánamo - and the extraordinary rendition programme, and to ensure that such violations will not recur in the future and that the fight against terrorism is pursued without breaching human rights, fundamental freedoms, democracy and the rule of law;
9. invite l'Union, les États membres et les autorités américaines à enquêter et à faire toute la lumière sur les violations de la législation internationale et nationale relative aux droits de l'homme, aux libertés fondamentales, à l'interdiction de la torture et des mauvais traitements, aux disparitions forcées et au droit à un procès équitable, commises dans le cadre de la "guerre contre le terrorisme" afin de déterminer les responsabilités en ce qui concerne les centres de détention secrets – et notamment Guantánamo – ainsi que le programme de restitutions extraordinaires, et à faire en sorte que de telles violations ne se reproduisent pas à l'avenir et que la lutte contre le terrorisme soit menée dans le respect des droits de l'homme, des libertés fondamentales, de la démocratie et de l'état de droit;

Expects concrete actions by the new Commissioner responsible, in line with already declared intentions: particularly and most importantly, welcomes the commitment to introduce a fundamental-rights impact assessment of all new legislative proposals; to oversee the legislative process to ensure that emerging final texts comply with the Charter; to apply a ‘zero tolerance’ policy on violations of the Charter, conducting in-depth investigations and initiating infringement procedures when Member States are in breach of their human rights obligations in implementing EU law; and to make sure EU citizens are properly informed on the new fundamental-rights architecture; calls for follow-up to the 2003 Communication on Article 7 of the Treaty on European Union (COM(2003)0606) to define a transparent and coherent way to address possible violations of human rights and make relevant use of Article 7 TEU on the basis of the new fundamental-rights architecture;

Calls on the Council and the Commission to make greater efforts to improve the ability of the European Union to respond rapidly to breaches of human rights by third countries, not least by mainstreaming human rights policy into all external European Union policies vis-à-vis such countries and systematically addressing human rights issues within the framework of the political dialogue at all levels;
invite le Conseil et la Commission à accentuer les efforts pour rendre l'Union plus apte à réagir rapidement aux violations des Droits de l'homme dans des pays tiers, notamment en intégrant la politique des Droits de l'homme dans toutes les politiques extérieures menées par l'Union européenne avec ces pays et en examinant systématiquement les questions relevant des Droits de l'homme dans le cadre du dialogue politique à tous les niveaux.

Asks the Council to participate in debates on resolutions on urgent cases of breaches of human rights, democracy and the rule of law and calls for the Subcommittee on Human Rights to be given a more constructive role in the development of consistent and transparent criteria for the selection of urgency topics;
invite le Conseil à prendre davantage part aux débats sur ses résolutions concernant des cas urgents de violation des Droits de l'homme, de la démocratie et de l'État de droit et souhaite qu'il soit donné à sa sous-commission «Droits de l'homme» un rôle plus constructif dans la définition de critères cohérents et transparents pour la sélection des questions urgentes;

Reiterates its call for the human rights clauses to be implemented through a more transparent procedure of consultation between the parties, detailing the political and legal mechanisms to be used in the event of a request for bilateral cooperation being suspended on the grounds of repeated and/or systematic human rights violations in breach of international law; considers that such clauses should also include details of a mechanism to allow for the temporary suspension of a cooperation agreement as well as a ‘warning mechanism’;

You cannot cherry-pick when it comes to human rights, and it is not by breaching human rights that the conflict will be de-escalated. If the European Union wants to help resolve the conflict, it must work with Russia and press it for further changes in its policy towards Chechnya.
Les droits de l’homme sont les mêmes pour tous et leur violation ne contribue nullement à apaiser le conflit. Si l’Union européenne entend contribuer à résoudre ce conflit, elle doit travailler avec la Russie et la presser de poursuivre les changements dans sa politique vis-à-vis de la Tchétchénie.
