Definition: This block contains a wide variety of disorders that differ in severity and clinical form but that are all attributable to the use of one or more psychoactive substances, which may or may not have been medically prescribed. The third character of the code identifies the substance involved, and the fourth character specifies the clinical state. The codes should be used, as required, for each substance specified, but it should be noted that not all fourth character codes are applicable to all substances. Identification of the psychoactive substance should be based on as many sources of information as possible. (17) Since the objective of the proposed action, namely better foreseeability of court judgments requiring genuinely uniform rules on the law applicable to contractual obligations determined by a mandatory and directly applicable Community legal instrument, cannot be adequately attained by the Member States, who cannot lay down uniform Community rules, and can therefore, by reason of its effects throughout the Community, be better achieved at Community level, the Community can take measures, in accordance with the subsidiarity principle set out in Article 5 of the Treaty. In accordance with the proportionality principle set out in that Article, a Regulation, which increases certainty in the law without requiring harmonisation of the substantive rules of domestic law, does not go beyond what is necessary to attain that objective.

- The second proposal is that there should be a five-year time-bar on the recovery of sums owed to the Community. This limit could be extended in cases where active steps are being taken to secure recovery. As things stand, there is no general time-limit of a ‘Community’ nature (such a limit exists in certain sectoral regulations e.g. those concerning the Staff Regulations: 5 years, the regulation on the protection of the communities’ financial interests: 4 years). However, there is interference with the national legislation, where the contract refers to national law or where the judge is a national one applying his own law as the law of procedure. This could give rise to total chaos in those Member States where institutions’ right to collect debts is time-barred (after 3 or 10 years), or where, quite simply, no information is given on whether the deadline has lapsed until the case comes before the judge. Nor is it clear whether after the period has elapsed it is possible to accept compensation or spontaneous payment by the debtor. In brief, this proposal would introduce legal certainty for both the institutions and the debtors.

(5) In the absence of uniform rules at Community level, obstacles to cross-border services and goods or the freedom of establishment might be justified in the light of the case-law of the Court of Justice as long as they seek to protect recognised public interest objectives and are proportionate to those objectives; in the light of Community objectives, of the provisions of the Treaty relating to free movement, of secondary Community law, and in accordance with the Commission’s policy on commercial communications , such obstacles can only be eliminated by establishing uniform rules at Community level and by clarifying certain legal concepts at Community level to the extent necessary for the proper functioning of the Internal Market; other restrictions have been identified as requiring replacement by less restrictive measures; remaining restrictions relating to the use and communication of sales promotions should be submitted to the principle of mutual recognition of national legislation.

(2) The Munich Convention on the Grant of European Patents of 5 October 1973 (hereinafter referred to as the "Munich Convention") established the European Patent Office (hereinafter referred to as "the Office") and entrusted it with the task of granting European patents. This Recommendation is mainly aimed at Community nationals who would like to experience living in a Member State other than their country of origin. It must also be noted that the European Council confirmed at its special meeting in Tampere on 15 and 16 October 1999 that the European Union must ensure equal treatment for third country nationals who are legally resident in a Member State, and that a Community policy on integration should aim to offer them rights and obligations comparable to those of EU citizens. Third country nationals who are legally and permanently resident in the Community should also benefit from the provisions of the acquis communautaire relating to freedom of movement and equality of treatment and from the provisions of this Recommendation. Similarly, third country nationals who take part in a Community programme such as Socrates, Leonardo da Vinci or the European Voluntary Service, should benefit from these provisions.
la présente recommandation vise avant tout les ressortissants communautaires qui souhaitent connaître une expérience dans un État membre autre que leur État d'origine; il faut rappeler que le Conseil européen lors de sa réunion spéciale de Tampere les 15 et 16 octobre 1999, a affirmé que l'Union européenne doit assurer un traitement équitable aux ressortissants de pays tiers qui résident légalement sur le territoire d'un État membre, et qu'une politique communautaire en matière d'intégration devrait avoir pour ambition de leur offrir des droits et obligations comparables à ceux des citoyens de la Communauté ; les ressortissants des pays tiers en séjour légal et durable dans la Communauté devraient également bénéficier des dispositions de l'acquis communautaire en matière de libre circulation et d'égalité de traitement ainsi que de celles de la recommandation; de même, les ressortissants des pays tiers qui participent à un programme communautaire tel que Socrates, Leonardo da Vinci ou le Service volontaire européen, devraient bénéficier de ces dispositions;
