The respondent's reasonable expectation of privacy with respect to the information sought by the Canadian authorities is determined and the action of the Canadian authorities, the issuing of the letter of request, effectively puts the respondent's privacy interests in jeopardy; s. 8 therefore applies to balance the interests of the state and those of the respondent through a judicial preauthorization procedure.
L'intimé a bel et bien une attente raisonnable en matière de vie privée relativement aux renseignements demandés par les autorités canadiennes et la mesure prise par ces dernières, c'est-à-dire l'envoi d'une lettre de demande, met en péril le droit de l'intimé au respect de sa vie privée. L'article 8 s'applique donc pour équilibrer, par une procédure d'autorisation judiciaire préalable, les intérêts de l'État et ceux de l'intimé.
