Formal arrangements are defined as the following services: pre-school or equivalent, compulsory education, centre-based services outside school hours, a collective crèche or another day-care centre, including family day-care and professional certified childminders.
Par «cadre institutionnel», on entend les services suivants: établissements préscolaires et assimilés, école obligatoire, services en centre d’accueil en dehors des heures de classe, crèches collectives et autres services de garderie, y compris les gardes de jour en milieu familial et les nourrices professionnelles agréées.

On that point, in particular, the Court states that Member States, like Portugal, which have established a system providing benefits in kind (that is to say, a system under which the insured persons have the right, not to reimbursement of the costs incurred for medical care, but to the care itself) are required to provide mechanisms for ex post reimbursement in respect of care provided in another Member State.

Secondly, the Court examines the situation relating to other forms of medical care, that is to say, non-hospital care provided in another Member State, other than the care covered by the Portuguese Decree-Law, not involving the use of major and costly equipment and not covered by Regulation No 1408/71.

In the meantime, however, on 5 October 2010, the Court of Justice ruled that it was compatible with EU law for a Member State to make reimbursement for non-hospital care planned in another Member State subject to prior authorisation if that care required the use of major and costly equipment. Following that judgment, the Commission decided to review the scope of the present action.

Namely, where the state of health of a worker affiliated to the Portuguese health system gives rise to the need for medical services in the course of a stay in the territory of another Member State (unforeseen treatment) or where the worker has received prior authorisation from the competent institution to go to the territory of another Member State to receive treatment there, the reimbursement rates being those applicable in the Member State where treatment is received (planned care authorised in advance).
À savoir, lorsque l’état de santé du travailleur affilié au système de santé portugais vient à nécessiter des prestations médicales au cours d’un séjour sur le territoire d’un autre État membre (soins inopinés) ou lorsque le travailleur a été préalablement autorisé par l’institution compétente à se rendre sur le territoire d’un autre État membre pour y recevoir des soins, selon les barèmes applicables dans l’État membre du traitement (soins programmés préalablement autorisés).

In any event, if a Member State decides to establish a system of prior authorisation for assumption of costs of hospital or specialised care provided in another Member State in accordance with the provision of this Directive, the costs of such care provided in another Member State should also be reimbursed by the Member State of affiliation up to the level of costs that would have been assumed had the same healthcare been provided in the Member State of affiliation, without exceeding the actual costs of healthcare received.
En tout état de cause, lorsqu’un État membre décide de mettre en place un système d’autorisation préalable pour la prise en charge des coûts de soins hospitaliers ou spécialisés dispensés dans un autre État membre conformément aux dispositions de la présente directive, il y a lieu que les coûts de tels soins de santé dispensés dans un autre État membre soient également remboursés par l’État membre d’affiliation à hauteur des coûts qui auraient été pris en charge si des soins de santé identiques avaient été dispensés dans l’État membre d’affiliation, sans que cela dépasse les coûts réels des soins de santé reçus.

1. If an authority having jurisdiction under Articles 5 to 10 contemplates the placement of the child in a foster family or institutional care, or the provision of care by kafala or an analogous institution, and if such placement or such provision of care is to take place in another Contracting State, it shall first consult with the Central Authority or other competent authority of the latter State.

The latter contains a number of key provisions for the promotion of mobility and the improvement of protection levels for migrant workers and their families, such as: the possibility of extending the period during which a jobseeker can look for work in another Member State from 3 to 6 months; the possibility of exporting pre-retirement benefits; the possibility for unemployed frontier workers to seek a job in the Member State of former employment by keeping their entitlement to unemployment benefits in the Member State of residence; and significant improvement in health care protection for family members of a frontier worker by granting them not only entitlement to health care in the Member State of residence, but also in the Member State where they work.

3. Paragraph 1 shall not apply where processing of the data is required for the purposes of preventive medicine, medical diagnosis, the provision of care or treatment or the management of health-care services, and where those data are processed by a health professional subject to the obligation of professional secrecy or by another person also subject to an equivalent obligation of secrecy.
