In a number of judgments handed down prior to the entry into force of the new Treaty the CJEU had invoked the right to local self-government and made it clear that the ‘possibility for public authorities to use their own resources to perform the public-interest tasks conferred on them may be exercised in cooperation with other public authorities’ (Case C-480/06, Stadtwerke Hamburg).
Dans plusieurs arrêts, la Cour de justice de l'Union européenne a déjà invoqué le droit à l'autonomie communale et fait observer "qu'une autorité publique peut accomplir les tâches d'intérêt public qui lui incombent par ses propres moyens (.) et qu'elle peut aussi le faire en collaboration avec d'autres autorités publiques" (C–480/06 Stadwerke Hamburg).
