(2) In a letter dated 19 February 2003 the Commission, after having reexamined the file and its Decision 2002/827/ECSC and having regard to certain arguments presented by the said company in the context of case T-291/02 heard by the Court of First Instance of the European Communities, informed Spain of its decision to initiate the procedure laid down in Article 88(2) of the Treaty with a view to repealing Articles 1, 2 and 5 of Decision 2002/827/ECSC and replacing the latter by a new final decision.
(2) Par lettre du 19 février 2003, la Commission, après avoir réexaminé le dossier et sa décision 2002/827/CECA et au vu de certains arguments présentés par l'entreprise précitée dans le cadre de l'affaire T-291/02 devant le Tribunal de première instance des Communautés européennes, a informé l'Espagne de sa décision d'engager la procédure prévue à l'article 88, paragraphe 2, du traité en vue de la suppression des articles premier, 2 et 5 de la décision 2002/827/CECA et du remplacement de cette dernière par une nouvelle décision finale.

By holding that the measures at issue in Joined Cases T-30/01 to T-32/01 and T-86/02 to T-88/02 are not analogous to the tax measure at issue for technical tax reasons and the because of amount of the subsidy, the CFI has distorted the issues between the parties, has disregarded the rule that the parties should be heard and has clearly misinterpreted the case-law specifically relating to the duty to state reasons.
