Stresses that China's human rights record remains a matter of serious concern and calls on the Council and the Commission to raise Liu Xiaobo's case at the next EU-China Summit; takes note of the previous human rights dialogues with China and the EU-China human rights dialogue of 20 November 2009; insists on the need for strict follow-up between all such dialogues in order to ensure that the recommendations are implemented;

Stresses that China's human rights record remains a matter of serious concern; insists on the need for rigorous follow-up between all rounds of the EU-China human rights dialogue, with a view to ensuring the application of the recommendations resulting from previous dialogues, which were mutually agreed by both parties, and in the form of the EU-China legal seminars on human rights which used to precede the rounds of the dialogue and which involved academic and civil-society representatives; calls on the Council and the Commission to put the questions of abolition of the death penalty and observance of ethnic minorities' and religious rights on the agenda for the 12th EU-China Summit on 30 November 2009, and to continue to pursue inclusion in the new Partnership and Cooperation Agreement, currently in negotiation, of a clause concerning respect for human rights in China;

Regrets that China's human rights record remains a matter of serious concern; emphasises, therefore, the need to considerably strengthen and improve the EU-China human rights dialogue; calls on the Council to provide a more detailed briefing to Parliament; considers it relevant to continue to organise the EU-China legal seminar on human rights, which used to precede the dialogue, with the participation of academic and civil society representatives, and in this regard welcomes the establishment of an EU-China Human Rights Academic Network under Objective 3 of the European Instrument for Democracy and Human Rights (EIDHR) ; calls on the Commission to ensure that this network will effectively function in cooperation with Parliament;

Emphasises the need to strengthen and improve the EU-China human rights dialogue considerably; recognises that China has now decided to have all death penalty cases reviewed by the Supreme Court, but remains concerned that China still carries out the majority of executions worldwide; stresses that China's human rights record remains a matter of serious concern; calls on the Council to provide a more detailed briefing to Parliament in public session following discussions; stresses the importance of reiterating points that were raised in previous dialogues; supports the Commission and the Council in their current reflections on ways of improving the dialogue; notes that, despite significant economic reforms, political and human rights concerns still persist regarding such matters as political imprisonment, forced labour, freedom of expression and religion, rights of religious and ethnic minorities, the Laogai camp system and allegations of organ harvesting; notes that such concerns should receive more focus in the build-up to the Beijing Olympic games; urges the EU to ensure that its trading relationship with China is contingent upon human rights reforms and calls in this regard on the Council to make a comprehensive evaluation of the human rights situation before finalising any new Partnership and Cooperation Framework Agreement; calls on the Council and the Commission to raise the issue of Tibet and to actively support the strengthening of the dialogue between the Chinese Government and envoys of the Dalai Lama;

The Council welcomes the exchanges with China on human rights at the EU-China Summit; the EU China Foreign Ministers troika; and at two rounds of the EU China human rights dialogue.

Serious shortcomings in China's human rights record remain, including in such areas as the suppression of freedoms among certain ethnic minorities and political dissidents, the use of enforced prison labour and the extensive use of the death penalty.
