That distinctive character must be assessed, first, by reference to the products or services in respect of which registration has been applied for and, second, by reference to the perception of the relevant public, which consists of average consumers of the products or services in question, who are reasonably well informed and reasonably observant and circumspect (see, inter alia, Linde, paragraph 41, and Case C‑363/99 KoninklijkeKPN Nederland [2004] ECR I‑0000, paragraph 34).
Ce caractère distinctif doit être apprécié, d’une part, par rapport aux produits ou aux services pour lesquels l’enregistrement est demandé et, d’autre part, par rapport à la perception qu’en a le public pertinent, qui est constitué par le consommateur moyen desdits produits ou services, normalement informé et raisonnablement attentif et avisé (voir arrêts Linde e.a., précité, point 41, et du 12 février 2004, Koninklijke KPN Nederland, C‑363/99, non encore publié au Recueil, point 34).
