It is necessary to defer the application of the provision on the availability, in the database for the early detection and exclusion system, of the information on fraud and irregularities contained in the automated information system of the Commission (the Irregularity Management System) until the database can receive this information.

Under Article 3 of that Regulation concerning irregularities and the recovery of sums wrongly paid in connection with the financing of the Cohesion Fund and the organisation of an information system in this field, the beneficiary Member States are obliged to notify the Commission of irregularities which have been the subject of initial administrative or judicial investigations.

Notes that, due to the availability of new information as a result of the significant changes in the way Member States and the Commission report irregularities, there has been a shift in focus in the Commission’s 2013 annual report from irregularities treated in general terms to those reported as fraudulent; invites the Commission to maintain this approach in its future Annual Report on the Protection of the EU’s Financial Interests – Fight against fraud; strongly urges the Commission, however, to further increase the availability of information and enhance analyses on the scope, types and impact of non-fraudulent irregularities in light of the significantly high number thereof and the related negative monetary impact, which adversely affects the financial interests of the EU;

Recalls that as from 1 January 2007, Member States are obliged to inform the Commission of irregularities involving more than EUR 10 000, the threshold introduced by Commission Regulation (EC) No 1848/2006 of 14 December 2006 concerning irregularities and the recovery of sums wrongly paid in connection with the financing of the common agricultural policy and the organisation of an information system in this field ; observes that the number of cases of irregularities reported was down 53% (1 548 cases, compared to 3 294 in 2006); points out that this relatively low number of irregularities can be explained by the higher threshold for reporting;

Underlines that for the Structural Fund programming period 2000-2006 reporting by the Member States and the Commission of irregularities has to be strengthened; the action plan adopted by the Commission has to be closely monitored; a new reporting scheme on figures with definitions of their meaning and a classification of irregularities has to be worked out; this scheme and reporting has to be applied for the new programming period 2007-2013; the Commission made a firm commitment to work with the Member States on these issues and also with all the DGs dealing with recoveries in order to bring forward a unified reporting scheme on irregularities and recoveries; underlines that it will be an important point for the discharge in 2009;

During the two months following the end of each quarter, Member States shall report to the Commission any irregularities which have been the subject of a primary administrative and/or judicial finding.
