2. In addition, for all serious infringements which level cannot be linked to the value of the fishery products obtained by committing the serious infringement, Member States shall ensure that a natural person having committed or a legal person held liable for a serious infringement is punishable by an administrative fine of a minimum of at least 5.000 EUR and a maximum of at least 300.000 EUR for each serious infringement.

6. Each Member State shall take the measures necessary to ensure that the offence referred to in Article 2, when committed with serious negligence, is punishable by a maximum of at least between two and five years of imprisonment where the offence caused significant and widespread damage to water quality, to animal or vegetable species or to parts of them and the death or serious injury of persons.

Among these categories, there is the possibility to insert alerts on persons for the purpose of discreet surveillance and specific checks where there is clear evidence that the person intends to commit or is committing "numerous and extremely serious criminal offences" or when on the basis of past criminal offences there is reason to suspect that the person will also commit extremely serious criminal offences in the future (Art. 99).

[20] The provisions of this Convention shall not apply to any person with respect to whom there are serious reasons for considering that: (a) he has committed a crime against peace, a war crime, or a crime against humanity, as defined in the international instruments drawn up to make provision in respect of such crimes; (b) he has committed a serious non-political crime outside the country of refuge prior to his admission to that country as a refugee; (c) he has been guilty of acts contrary to the purposes and principles of the United Nations.

I do not think that this code will be useful unless it is effective in preventing weapons from reaching the hands of people who are committing very serious violations against human rights, as these people are.
