The commitment appropriations and the non-differentiated appropriations relating to building projects referred to in Article 13(2)(a) of the Financial Regulation may be carried over only if the commitments could not be made before 31 December of the financial year for reasons not attributable to the authorising officer and if the preparatory stages are sufficiently advanced to make it reasonable to surmise that the commitment will be made by no later than 31 March of the following year, or 31 December for building projects.

Les crédits d’engagement et les crédits non dissociés relatifs à des projets immobiliers visés à l’article 13, paragraphe 2, point a), du règlement financier ne peuvent être reportés que si les engagements n’ont pu être effectués avant le 31 décembre de l’exercice pour des raisons non imputables à l’ordonnateur et si les étapes préparatoires sont avancées à un point permettant raisonnablement d’estimer que l’engagement pourra être effectué au plus tard le 31 mars de l’année suivante ou le 31 décembre pour les projets immobiliers.

Notes the proposed increase in PA of 4,9% compared to 2011; is convinced that the Commission is proposing such figures on the basis of a careful and critical analysis of forecasts provided by Member States, which themselves co-manage 80% of the EU budget; notes that the bulk of this increase is linked to legal needs arising in relation to the 7th Research Programme and the Structural and Cohesion Funds; is convinced that the proposed level of payments represents the bare minimum required to honour EU legal commitments made in previous years and that it is the EU's duty to comply with the legal obligations deriving from these commitments and ensure that programmes unfold their full potential and run at full speed; strongly urges the Council, therefore, to refrain from cutting the proposed level of payments; expresses its intention to keep the level of payments at the level proposed by the Commission in the Draft Budget, particularly in view of Council's early 2011 reluctance to honour its formal commitment of December 2010 to providing fresh appropriations in case of need;

In this respect the Commission should present a report justifying the state of play regarding the implementation of the amendments voted by Parliament last year, with special attention to those budget lines with less than 10% implementation, and should by 15 November present proposals for more efficient means of implementing the budget; fulfilment of its commitment of December 2000;

3. Appropriations for commitment of differentiated appropriations and non-differentiated appropriations not yet committed at the close of the financial year may be carried over in respect of amounts corresponding to commitment appropriations for which most of the preparatory stages of the commitment procedure, to be defined in the rules implementing the financial regulation of each Community body, have been completed by 31 December; these amounts may then be committed up to 31 March of the following year.
3. Pour les crédits d'engagement des crédits dissociés et les crédits non dissociés non encore engagés à la clôture de l'exercice, le report peut porter sur les montants correspondant aux crédits d'engagement pour lesquels la plupart des étapes préparatoires à l'acte d'engagement, à définir dans les modalités d'exécution du règlement financier de chaque organisme communautaire, sont achevées au 31 décembre; ces montants peuvent être engagés jusqu'au 31 mars de l'année suivante.

4. Commitments shall be entered in the accounts on the basis of the legal commitments entered into up to 31 December, subject to the global commitments referred to in Article 77(2) and the financing agreements referred to in Article 166(2), which shall be entered in the accounts on the basis of the budget commitments up to 31 December.

Les engagements de crédits sont comptabilisés sur la base des engagements juridiques effectués jusqu'au 31 décembre, sous réserve des engagements globaux visés à l'article 77, paragraphe 2, et des conventions de financement visées à l'article 166, paragraphe 2, qui sont comptabilisés sur la base des engagements budgétaires effectués jusqu'au 31 décembre.

It is therefore important to understand the difference that exists at the moment between problems caused by applications which cannot be met because of budgetary considerations and the processing of commitments, where the situation, despite difficulties at the beginning of the year, has improved; and it is worth remembering that some of the problems at the beginning of the year had a little to do with the lateness of receipt of commitments in December.
Il est donc important de comprendre la différence existant en ce moment entre les problèmes causés par les applications qui ne peuvent être satisfaites en raison de considérations budgétaires et le traitement des engagements dont la situation s'est améliorée, malgré les difficultés rencontrées au début de l'année ; il est également judicieux de se rappeler que certains problèmes apparus au début de l'année ont quelque peu été provoqués par le retard pris par la réception des engagements au mois de décembre.
