1. Any agreements resulting from this Regulation shall contain provisions ensuring the protection of the Community's financial interests, in particular with respect to irregularities, fraud, corruption and any other illegal activity, in accordance with Council Regulation (EC, Euratom) No 2988/95 of 18 December 1995 on the protection of the European Communities' financial interests (16), Council Regulation (Euratom, EC) No 2185/96 of 11 November 1996 concerning on-the-spot checks and inspections carried out by the Commission in order to protect the European Communities' financial interests against fraud and other irregularities (17) and Regulation (EC) No 1073/1999 of the European Parliament and of the Council of 25 May 1999 concerning investigations conducted by the European Antifraud Office (OLAF) (18).
1. Tout accord découlant du présent règlement comporte des dispositions assurant la protection des intérêts financiers de la Communauté, notamment à l'égard des irrégularités, de la fraude, de la corruption et d'autres activités illicites, conformément au règlement (CE, Euratom) no 2988/1995 du 18 décembre 1995 relatif à la protection des intérêts financiers des Communautés européennes (16), au règlement (CE, Euratom) no 2185/96 du Conseil du 11 novembre 1996 relatif aux contrôles et vérifications sur place effectués par la Commission pour la protection des intérêts financiers des Communautés européennes contre les fraudes et autres irrégularités (17) et au règlement (CE) no 1073/1999 du Parlement européen et du Conseil du 25 mai 1999 relatif aux enquêtes effectuées par l'Office européen de lutte antifraude (OLAF) (18).

Whereas the authorizations granted to investment firms by the competent national authorities pursuant to this Directive will have Community-wide, and no longer merely nationwide application, and existing reciprocity clauses will henceforth have no effect; whereas a flexible procedure is therefore needed to make it possible to assess reciprocity on a Community basis; whereas the aim of this procedure is not to close the Community's financial markets but rather, as the Community intends to keep its financial markets open to the rest of the world, to improve the liberalization of the global financial markets in third countries; whereas, to that end, this Directive provides for procedures for negotiating with third countries and, as a last resort, for the possibility of taking measures involving the suspension of new applications for authorization and the restriction of new authorizations;
considérant que les agréments d'entreprises d'investissement accordés par les autorités nationales compétentes conformément aux dispositions de la présente directive auront une portée communautaire, et non plus seulement nationale, et que les clauses de réciprocité existantes seront désormais sans effet; qu'il faut donc une procédure souple qui permette d'évaluer la réciprocité sur une base communautaire; que le but de cette procédure n'est pas de fermer les marchés financiers de la Communauté mais, comme la Communauté se propose de garder ses marchés financiers ouverts au reste du monde, d'améliorer la libéralisation des marchés financiers globaux dans les pays tiers; que, à cette fin, la présente directive prévoit des procédures de négociation avec des pays tiers et, en dernier ressort, la possibilité de prendre des mesures consistant à suspendre de nouvelles demandes d'agrément ou à limiter les nouveaux agréments;
