9. Where credit institutions are allowed under national law to operate under different trademarks as defined in Article 2 of Directive 2008/95/EC of the European Parliament and of the Council , the Member State shall ensure that depositors are informed clearly that the credit institution operates under different trademarks and that the coverage level laid down in Article 6(1), (2) and (3) of this Directive applies to the aggregated deposits the depositor holds with the credit institution.

When laying down Community rules, an effective control mechanism must also be established, which, eliminating the principle of country of origin or country of provenance, makes it possible for the European Union institutions to monitor the operations of institutions operating across national borders.

(1) The objective of Decision No 1720/1999/EC of the European Parliament and of the Council(4) is for the Community to achieve a high degree of interoperability between the trans-European telematic networks established between the Member States and the Community institutions in order to support the establishment of economic and monetary union and the implementation of Community policies, as well as to achieve substantial benefits for Member State administrations and the Community by streamlining operations and speeding up implementation of new networks and enhancements.

The objective of Decision No 1719/1999/EC of the European Parliament and of the Council is for the Community, in co-operation with the Member States, to take the necessary measures to establish operational, interoperable, trans-European telematic networks between Member State administrations and the Community institutions, enabling the efficient, effective and secure interchange of information in order to support the establishment of economic and monetary union and the implementation of Community policies, as well as the Community decision-making process.

33. Reiterates its call for OLAF, as an office with a horizontal and interinstitutional remit, also to set up units in Luxembourg and draws attention in this context to the importance of Luxembourg for the Community's financial operations and its institutions and services (almost 7000 officials);

Whenever it appears to the Commission, either on the basis of the reports referred to in paragraph 3 or on the basis of other information, that a third country is not granting Community credit institutions effective market access comparable to that granted by the Community to credit institutions from that third country, the Commission may submit proposals to the Council for the appropriate mandate for negotiation with a view to obtaining comparable competitive opportunities for Community credit institutions.

Lorsque la Commission constate, soit sur la base des rapports visés au paragraphe 3, soit sur la base d'autres informations, qu'un pays tiers n'accorde pas aux établissements de crédit de la Communauté un accès effectif au marché comparable à celui qu'offre la Communauté aux établissements de crédit de ce pays tiers, elle peut soumettre des propositions au Conseil en vue d'obtenir un mandat de négociation approprié pour obtenir des possibilités de concurrence comparables pour les établissements de crédit de la Communauté.
