Regulation (EC) No 45/2001 of the European Parliament and of the Council of 18 December 2000 on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data and in particular thereof concerning confidentiality and security of processing apply to the processing of personal data by the Community institutions and bodies when carrying out their responsibilities in the operational management of SIS II in the exercise of activities all or part of which fall within the scope of Community law.

Where a Community institution or body receives a request for access to environmental information and where this information is not held by that Community institution or body, it shall, as promptly as possible, but within 15 working days at the latest, inform the applicant of the Community institution or body or the public authority within the meaning of Directive 2003/4/EC to which it believes it is possible to apply for the information requested or transfer the request to the relevant Community institution or body or the public authority and inform the applicant accordingly.

(2) Priority should be given to those projects which enhance the economic viability of public administrations, European Community institutions, Member States and the regions, and which, by means of the establishment or enhancement of sectoral networks, contribute to the objectives of the eEurope initiative and related action plan, in particular the chapter on government online, aimed at benefiting national parliaments, citizens and enterprises, and to other initiatives aimed at improving the transparency of activities of the Community institutions as required by Article 255 of the Treaty and by Regulation (EC) No 1049/2001 of the European Parliament and of the Council of 30 May 2001 regarding public access to European Parliament, Council and Commission documents(5).

To this end measures should be adopted which are binding on the Community institutions and bodies. These measures should apply to all processing of personal data by Community institutions and bodies insofar as such processing is carried out in the exercise of activities all or part of which fall within the scope of Community law.

In the light of this, what is the Commission’s view of the failure to complete the project? Has it been asked by the Greek Government for the commitment of appropriations from the Urban Development subprogramme for the Thessaloniki underground railway under the second CSF which is, of course, expiring? Has the transfer agreement to the second Thessaloniki underground rail contractor been registered with the Community institutions’ departments and is it consistent with the requirements of public contract-awarding and also with Community legislation? In the context of the investigations which the European Ombudsman is conducting, has the file of complaints examined concerning the Thessaloniki underground railway revealed any liability on the part of the Commission?

2. The reduction in the number of types of committee and greater transparency in the functioning thereof should also enable members of the general public to understand and to have access to Community legislation. The Commission should inform Parliament more effectively and more regularly about the work of the committees, which will help to cultivate the habit of providing information and will reflect greater transparency. Regular publication of the committees' proceedings and the availability of information regarding the composition thereof, the agendas for their meetings and the decisions they take will help to make good the transparency deficit which all the Community institutions agree exists.

The Community institutions and the Member States acknowledge the importance of effective protection for the Community's financial interests. In order to combat fraud and other illegal activities affecting those interests, the Member States signed the Convention of 26 July 1995 on the protection of the European Communities' financial interests and several additional protocols which provide for measures aimed in particular at aligning national criminal laws. As these instruments have still not been ratified by all the Member States, the Commission has presented a proposal for a Directive on the basis of new Article 280 of the EC Treaty introduced by the Amsterdam Treaty, which incorporates a large proportion of their provisions.
Pour mieux lutter contre la fraude et les autres activités illégales portant atteinte aux intérêts financiers de l’Union européenne (UE), les États membres ont signé la Convention relative à la protection des intérêts financiers des Communautés, du 26 juillet 1995, ainsi que plusieurs protocoles additionnels. Ces instruments visent à harmoniser les législations pénales nationales en matière de protection des intérêts financiers de l’UE mais les délais de transposition par les États membres ont incité la Commission à présenter une proposition de directive qui reprend une grande partie de ces dispositions.
