Since the objective of this Regulation, namely harmonisation of the conditions for the placing on the market and the use of feed, in order to ensure a high level of feed safety and thus a high level of protection of public health as well as to provide adequate information for users and consumers and to strengthen the effective functioning of the internal market, cannot be sufficiently achieved by the Member States and can therefore be better achieved at Community level, the Community may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.
Étant donné que l’objectif du présent règlement, à savoir harmoniser les conditions de mise sur le marché et d’utilisation des aliments pour animaux, de manière à garantir un niveau élevé de sécurité des aliments pour animaux et donc un niveau élevé de protection de la santé publique ainsi qu’à fournir une information adéquate aux utilisateurs et aux consommateurs et à renforcer le bon fonctionnement du marché intérieur, ne peut pas être réalisé de manière suffisante par les États membres et peut donc être mieux réalisé au niveau communautaire, la Communauté peut prendre des mesures, conformément au principe de subsidiarité consacré à l’article 5 du traité.

(25) Since the objectives of the proposed action, namely to facilitate the creation of Community-wide information products and services based on public sector documents, to enhance an effective cross-border use of public sector documents by private companies for added-value information products and services and to limit distortions of competition on the Community market, cannot be sufficiently achieved by the Member States and can therefore, in view of the intrinsic Community scope and impact of the said action, be better achieved at Community level, the Community may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.

Considers that, while market failures persistently occur, there is a need to work with ex ante obligations, formulated in a Directive and implemented by the NRAs with notification to the Commission, in order to avoid abuse of dominant positions; advocates that Member States be required to develop and lay down a binding model for cooperation between NRAs and national competition authorities and audiovisual sector regulators; believes that NRAs must act in accordance with pre-defined guidelines published by the Commission and that the guidelines must contain market definitions in order to achieve common, objective criteria which minimise the need for case-by-case assessments by regulators; notes that the question of market power is very complex, one which cannot be covered in one mechanical model; believes that the vertical, horizontal and intersectoral analysis of the economic market situation is best made at a decentralised level by the NRA or by the NRA together with the Competition Authority and that, in any situation of market failure that may arise, the NRAs must propose measures of regulation in a manner appropriate to the gradation of market failure in the sector and aimed at more competition and must consult the market players to find out if the sector can break the logjam in question without regulation; takes the view that NRAs have to justify their decisions against pre-defined guidelines published by the Commission in order to achieve common, objective criteria which minimise the need for non-objective judgements by regulators; considers that the instruments for regulating access, including interconnection, should not be extended to the mobile communications market and Internet service providers; and that the Commission must be able to challenge and possibly revoke the decisions taken by the NRAs if they are not justified according to the regulatory framework; calls for the imposed measures to be published and to be applicable for a limited peri ...

The measures adopted and implemented in the internal market programme to remove barriers to trade and further integrate the Community markets cannot be ignored when assessing the effects on competition of a concentration or a structural joint venture.
