France has decided to amend the public service obligations imposed in respect of scheduled air services between the airports of Rennes (Saint-Jacques) and Basel-Mulhouse and published in Official Journal of the European Union C 52 of 2 March 2006 pursuant to Article 4(1)(a) of Council Regulation (EEC) No 2408/92 of 23 July 1992 on access for Community air carriers to intra-Community air routes.
La France a décidé de modifier les obligations de service public imposées sur les services aériens réguliers entre l'aéroport de Rennes (Saint-Jacques) et celui de Bâle-Mulhouse publiées au Journal officiel de l'Union européenne C 52 du 2 mars 2006, au titre de l'article 4, paragraphe 1, point a), du règlement (CEE) no 2408/92 du Conseil du 23 juillet 1992 concernant l'accès des transporteurs aériens communautaires aux liaisons aériennes intra-communautaires.

6. When a Member State wishes to impose a public service obligation, it shall communicate the complete text of the envisaged imposition of the public service obligation to the Commission, to the other Member States concerned, to the airports concerned and to the air carriers operating the route in question.

Pursuant to Article 4(1)(a) of Council Regulation (EEC) No 2408/92 of 23 July 1992 on access for Community air carriers to intra-Community air routes, the United Kingdom has decided to impose a public service obligation in respect of a scheduled air service between Cardiff and RAF Valley, Anglesey.
Conformément à l'article 4, paragraphe 1, point a), du règlement (CEE) no 2408/92 du Conseil du 23 juillet 1992 concernant l'accès des transporteurs aériens communautaires aux liaisons aériennes intracommunautaires, le Royaume-Uni a décidé d'imposer une obligation de service public pour un service aérien régulier exploité entre Cardiff et RAF Valley (Royal Airforce Valley), Anglesey (île d'Anglesey).

In so far as it constitutes State aid, public service compensation that meets the conditions laid down by this Decision is compatible with the common market and shall be exempt from the obligation of prior notification provided for in Article 88(3) of the Treaty, without prejudice to the existence of provisions relating to public service obligations contained in sectoral Community legislation.
Dans la mesure où elles constituent des aides d'État, les compensations de service public qui remplissent les conditions fixées par la présente décision sont compatibles avec le marché commun et exonérées de l'obligation de notification préalable visée à l'article 88, paragraphe 3, du traité, sans préjudice de l'existence de dispositions relatives aux obligations de service public contenues dans des législations communautaires sectorielles.

[.] Fourth, where the undertaking which is to discharge public service obligations, in a specific case, is not chosen pursuant to a public procurement procedure which would allow for the selection of the tenderer capable of providing those services at the least cost to the community, the level of compensation needed must be determined on the basis of an analysis of the costs which a typical undertaking, well run and adequately provided with means of transport so as to be able to meet the necessary public service requirements, would have incurred in discharging those obligations, taking into account the relevant receipts and a reasonable profit for discharging the obligations’.
[.] Quatrièmement, lorsque le choix de l'entreprise à charger de l'exécution d'obligations de service public, dans un cas concret, n'est pas effectué dans le cadre d'une procédure de marché public permettant de sélectionner le candidat capable de fournir ces services au moindre coût pour la collectivité, le niveau de la compensation nécessaire doit être déterminé sur la base d'une analyse des coûts qu'une entreprise moyenne, bien gérée et adéquatement équipée en moyens de transport afin de pouvoir satisfaire aux exigences de service public requises, aurait encourus pour exécuter ces obligations, en tenant compte des recettes y relatives ainsi que d'un bénéfice raisonnable pour l'exécution de ces obligations».

In this judgment, the Court stated that public service compensation does not constitute an advantage in the meaning of Article 87(1) of the EC Treaty if all of the following four conditions are met: (1) the recipient undertaking must actually have public service obligations to discharge and these obligations must be clearly defined, (2) the parameters of the compensation must be established in advance in an objective and transparent manner, (3) the compensation does not exceed the costs incurred in discharging the public service obligations, (4) in order to ensure the least costs to the community, the company which is to discharge public service obligations is chosen either pursuant to a public procurement, or if not, the level of compensation is determined based on the costs of a typical, well run undertaking.
Conformément à cet arrêt, la compensation en contrepartie d’obligations de service public ne constitue pas une aide au sens de l’article 87, paragraphe 1, du traité CE, lorsque les conditions suivantes sont réunies: 1) l’entreprise bénéficiaire a effectivement été chargée de l’exécution d’obligations de service public et ces obligations ont été clairement définies; 2) les paramètres sur la base desquels est calculée la compensation ont été préalablement établis de façon objective et transparente; 3) la compensation ne dépasse pas ce qui est nécessaire pour couvrir tout ou partie des coûts occasionnés par l’exécution des obligations de service public; 4) afin de maintenir les coûts les plus bas possible dans l’intérêt de la communauté, l’entreprise chargée d’exécuter la mission de service public doit avoir été sélectionnée dans le cadre d’un appel d’offres; dans le cas contraire, les coûts pour l’exécution des services communautaires doivent être déterminés sur la base d’une entreprise moyenne bien dirigée.

All undertakings authorised by virtue of a general authorisation pursuant to Article 4(a) of Directive ././EC (on the authorisation of electronic communications networks and services) to provide electronic communications services accessible to the public shall have a right and, when requested by other undertakings authorised in one or more Member States , an obligation to negotiate interconnection and access on commercial terms with each other for the purpose of providing the services in question, in order to ensure provision and interoperability of services throughout the Community.
