Definition: Persistent and usually fluctuating disorders of mood in which the majority of the individual episodes are not sufficiently severe to warrant being described as hypomanic or mild depressive episodes. Because they last for many years, and sometimes for the greater part of the patient's adult life, they involve considerable distress and disability. In some instances, recurrent or single manic or depressive episodes may become superimposed on a persistent affective disorder.

This Directive lays down minimum rules concerning the right of access to a lawyer in criminal proceedings and in proceedings for the execution of a European arrest warrant pursuant to Council Framework Decision 2002/584/JHA of 13 June 2002 on the European arrest warrant and the surrender procedures between Member States (European arrest warrant proceedings) and the right to have a third party informed upon deprivation of liberty and to communicate with third persons and with consular authorities while deprived of liberty.
La présente directive définit des règles minimales concernant le droit d’accès à un avocat dans le cadre des procédures pénales et des procédures visant à exécuter un mandat d’arrêt européen en vertu de la décision-cadre 2002/584/JAI du Conseil du 13 juin 2002 relative au mandat d’arrêt européen et aux procédures de remise entre États membres (ci-après dénommées «procédures relatives au mandat d’arrêt européen») et le droit d’informer un tiers dès la privation de liberté ainsi que le droit, pour les personnes privées de liberté, de communiquer avec des tiers et avec les autorités consulaires.

Welcomes the execution by Belgium of the arrest warrant issued by ICC Pre-Trial Chamber III against Jean Pierre Bemba, on 3 July 2008; notes with great concern, however, that eight arrest warrants issued by the ICC, including those against four senior leaders of the Lord's Resistance Army (LRA) in Uganda, Bosco Ntaganda in the DRC, Ahmad Harun, Ali Kushayb and Sudanese President Omar Hassan Ahmad Al-Bashir, have not yet been executed; deplores the persistent failure and refusal of Sudan to arrest and transfer the suspects to the ICC in continuous disregard of its obligations under UN Security Council Resolution 1593 (2005); notes that on 26 May 2010 ICC Pre-Trial Chamber I informed the United Nations Security Council of the lack of cooperation by the Republic of the Sudan in the case against Harun and Kushayb; expresses great concern that two ICC States Parties, Chad and Kenya, recently invited and welcomed President Omar al-Bashir to their territories despite their obligation under the Rome Statute to arrest him, and failed to execute the relevant arrest warrant; calls for the continuing search for outstanding indictees, and stresses the role which the EU and ICC could play in ensuring that investigations are carried out into possible war crimes in Sri Lanka and the Democratic Republic of the Congo;

H. concerned that these problems may undermine mutual trust and lead to a chain reaction which could threaten the implementation of the European arrest warrant by other Member States, as is demonstrated by the fact that, following the decision by the German Constitutional Court to annul the legislation transposing the Framework Decision, a number of Member States have indicated that they will have to return to applying, on a transitional basis, the extradition instruments that existed before the European arrest warrant, pending adoption of a new transposing law that is compatible with the German Basic Law,

1. where the European arrest warrant has been issued for the purposes of executing a sentence or a detention order imposed by a decision rendered in absentia and if the person concerned has not been summoned in person or otherwise informed of the date and place of the hearing which led to the decision rendered in absentia, surrender may be subject to the condition that the issuing judicial authority gives an assurance deemed adequate to guarantee the person who is the subject of the European arrest warrant that he or she will have an opportunity to apply for a retrial of the case in the issuing Member State and to be present at the judgment.

2. In case the European arrest warrant is issued for the purpose of executing a custodial sentence or detention order under the conditions of paragraph 1(d) and the person concerned has not previously received any official information about the existence of the criminal proceedings against him or her, he or she may, when being informed about the content of the European arrest warrant, request to receive a copy of the judgment before being surrendered.
2. In relations between Member States, the European arrest warrant should replace all the previous instruments concerning extradition, including the provisions of Title III of the Convention implementing the Schengen Agreement which concern extradition.
Le mandat d'arrêt européen devrait remplacer, dans les relations entre États membres, tous les instruments antérieurs relatifs à l'extradition, y compris les dispositions du titre III de la convention d'application de l'accord de Schengen ayant trait à cette matière.

(11) In relations between Member States, the European arrest warrant should replace all the previous instruments concerning extradition, including the provisions of Title III of the Convention implementing the Schengen Agreement which concern extradition.
