That can only imply that if you challenge the act it is because the disposition feature is written by the government in such a way that the ownership is confirmed as being the government's. On the other hand, with the ownership feature being unresolved and eventually left up to the courts to decide, how can Parliament be asked to confirm a formula when that formula may not be applicable should the ownership of the surplus become a joint one, or is not totally that of the Crown?
On ne peut donc que conclure que, si on conteste la loi, c'est parce que la clause de disposition est rédigée de telle façon par le gouvernement qu'elle confirme que le surplus appartient à ce dernier. En revanche, étant donné que la question de la propriété n'est toujours pas réglée, voire qu'on laisse aux tribunaux le soin de la trancher, comment peut-on demander au Parlement de confirmer une formule quand on sait que cette dernière pourrait ne pas s'appliquer si la propriété du surplus devient conjointe ou que le surplus n'appartienne qu'en partie au gouvernement?

Our ombudsman role is carried out in part based on the privileges of members of Parliament which are fairly well articulated, constrained and referred to directly and indirectly in the Constitution, in the Parliament of Canada Act and in the common law handed down to us when Parliament was created 128 years ago (1340) I do not have to go over them but I will point out that in every session of Parliament it is important for MPs to resubmit our request to the Sovereign for confirmation of our privileges in the House of Commons.
