Following this consultation, the Commission considered that Community action was advisable and again consulted management and labour at Community level on the content of the planned proposal, pursuant to Article 138(3) of the Treaty.

Considers that the desertification process affecting various regions in the Union and its socio-economic repercussions and impact on the natural environment have not been adequately reflected or met with sufficient awareness in certain Community bodies; urges the Commission to submit a communication on desertification immediately; calls on the Commission, consequently, to include in it a Community action programme containing a precise description of the zonification of regions affected or likely to be affected by the desertification process, together with a detailed analysis of the causes and socio-economic effects on the regions and their consequences for the human environment, the natural environment and the water cycle, and to identify appropriate Community actions to help to limit the negative effects of that process;

Article 138 of the Treaty provides for a compulsory two-stage consultation procedure: before presenting proposals in the social policy field, the Commission is required to consult the social partners on the possible direction of Community action; on completion of that first stage, if the Commission considers that Community action is desirable, it has to consult the social partners on the actual content of the envisaged proposal.

Considers that the ambitious programme suggested by the Commission in its communication goes beyond the provisions of paragraphs 3 and 4 of Article 63 of the Treaty; consequently, despite considering the overall approach put forward by the Commission with regard to a future immigration policy to be sound, notes that Article 63 of the Treaty does not readily allow a Community management of migration flows since this continues to fall within the remit of the Member States, thus significantly limiting the scope for Community action and precluding anything beyond the simple coordination of different national policies.

Part of the protection of the Community's financial interests is outside the scope of Community action; the Member States consider that it falls under the third pillar (justice and home affairs): the part in question is the criminal law and judicial cooperation, on which there is a convention (of July 1995) and two proposals for a protocol under Article K.3 of Title VI of the EU Treaty.
