The competent authorities of the Member States consulted shall give their opinion or consent to the competent authorities of the home Member State of the transferring assurance undertaking within three months of receiving a request; the absence of any response from the authorities consulted within that period shall be considered equivalent to a favourable opinion or tacit consent.

In relation to the general framework for information and consultation, the Chapter IV of the European Union’s Charter of Fundamental Rights, entitled ‘Solidarity’, begins with Article 27, which establishes, under the title ‘Workers' right to information and consultation within the undertaking’, that ‘Workers or their representatives must, at the appropriate levels, be guaranteed information and consultation in good time in the cases and under the conditions provided for by Community law and national laws and practices’.

Calls on the Member States actively to foster measures to encourage self-employment and the establishment of SMEs (in the industrial, craft or trade sectors), particularly in areas involving innovative work; calls, therefore, for practical measures to support investment in these areas, facilitate access to risk capital by involving public and private financing bodies, introduce ad hoc consultation and training arrangements for the acquisition of the requisite skills, to provide an impetus for changing to a new organization of the learning process centred on communication and interaction between and within undertakings and between training and further training organizations and undertakings and research institutions, and to simplify legal and administrative procedures, without, however, abandoning high health protection and safety standards at the workplace;
11. invite les États membres à promouvoir activement des mesures propres à favoriser le travail autonome et la création de PME (industrielles, artisanales ou commerciales), en particulier dans des domaines à contenu innovateur; demande en conséquence que des actions concrètes soient menées pour soutenir l'investissement dans ces domaines, faciliter l'accès au capital à risque en associant des instituts financiers publics et privés, instaurer des structures de consultation et de formation ad hoc pour l'acquisition des qualifications requises en vue d'activer la mutation vers une nouvelle organisation du processus d'apprentissage, centrée sur la communication et l'interaction tant entre entreprises qu'à l'intérieur de celles-ci, ainsi qu'entre infrastructures de formation/perfectionnement et entreprises, et centres de recherche et de simplifier les procédures légales et administratives sans pour autant renoncer à des normes élevées de protection de la santé et de la sécurité dans les lieux de travail;
