TRADUCTIONS EN CONTEXTE

The General Assembly recalled that at the Second Review Conference of the Convention the international community had reviewed the implementation of the Convention, and that the States Parties to the Convention had adopted the Cartagena Action Plan, stressing the importance of the full and effective implementation of, and compliance with, the Convention, including through the implementation of the Cartagena Action Plan.
L’Assemblée générale a rappelé que, lors de la deuxième conférence d’examen de la convention, la communauté internationale avait examiné la mise en œuvre de la convention et que les États parties à la convention avaient adopté le plan d’action de Carthagène, soulignant à quel point il importait que la convention soit effectivement mise en œuvre et respectée dans son intégralité, notamment en appliquant le plan d’action de Carthagène.

Certain Articles of the Convention affect secondary Community legislation on jurisdiction and recognition and enforcement of judgments, in particular Council Regulation (EC) No 2201/2003 of 27 November 2003 concerning jurisdiction and the recognition and enforcement of judgments in matrimonial matters and the matters of parental responsibility (3).

The Commission argued that the provisions of the Convention were more detailed and that the scope was broader than existing Community legislation and that therefore, the Community should adopt the Regulation in order to fully apply the requirements of the Aarhus Convention to the Community institutions and bodies before ratifying the Aarhus Convention.

The Committee on Legal Affairs and the Internal market is essentially asked to verify the choice of the appropriate legal basis for the measure by which the Council proposes to conclude the Convention and, in particular, on whether the Community's consent to be bound by it should be founded on Articles 133 and 175 EC, and second, to consider whether the powers which the Member States would continue to exercise by reason of their participation in the Convention alongside the Community are, having regard to the matters covered, residual or preponderant in relation to those of the Community.
