TRADUCTIONS EN CONTEXTE

Given the major technical and economic developments occurring in television broadcasting and the appearance of new communication services in Europe since the Convention was adopted in 1989, and bearing in mind that the European Community had adopted Directive 97/36/EC of the European Parliament and Council of 30 June 1997 amending Directive 89/552/EEC, the Council of Europe saw an urgent need to amend some of the Convention's provisions in order to develop a coherent approach to transfrontier television between the Convention and the revised Directive.

(f) if the adoption is an international adoption and the country in which the adoption took place and the child's province of intended destination are parties to the Hague Convention on Adoption, the competent authority of the country and of the province have stated in writing that they approve the adoption as conforming to that Convention; and

(g) if the adoption is an international adoption and either the country in which the adoption took place or the child's province of intended destination is not a party to the Hague Convention on Adoption, there is no evidence that the adoption is for the purpose of child trafficking or undue gain within the meaning of that Convention.

6. This Convention shall not affect the application of the rules of a Regional Economic Integration Organisation that is a Party to this Convention, whether adopted before or after this Convention:

As agreed when Council Decision 2011/220/EU on the signing of the Convention was adopted, the Union should approve the Convention alone and exercise its competence over all the matters governed by it.

Thus, with regard to banned or severely restricted chemicals, Article 5(1) to (3) of the Convention provides, in essence, that, when a Party to the Convention has adopted a final regulatory action – defined by Article 2(e) of the Convention as ‘an action taken by a Party, that does not require subsequent regulatory action by that Party, the purpose of which is to ban or severely restrict a chemical’, it must as soon as possible give written notice of such action to the Secretariat established by the Convention, which must then verify whether the notification contains the information required in Annex I to the Convention, concerning in particular the identification of the chemical in question, its physical and chemical, toxicological and ecotoxicological properties and the reasons for the final regulatory action relevant to human health or the environment.
5 Ainsi, en ce qui concerne les produits chimiques interdits ou strictement réglementés, l’article 5, paragraphes 1 à 3, de la convention prévoit, en substance, que, lorsqu’une partie à la convention a adopté une mesure de réglementation finale – définie, à l’article 2, sous e), de la convention comme «une mesure prise par une partie, n’appelant pas de mesure de réglementation ultérieure de la part de cette partie et ayant pour objet d’interdire ou de réglementer strictement un produit chimique» –, elle doit en aviser dès que possible le secrétariat institué par la convention, lequel doit alors vérifier si la notification reçue comporte bien toutes les informations prévues à l’annexe I de la convention relatives, notamment, à l’identification du produit chimique concerné et à ses propriétés physico-chimiques, toxicologiques et écotoxicologiques, ainsi qu’aux raisons liées à la santé des personnes ou à l’environnement ayant motivé l’adoption de la mesure de réglementation finale.
