In political terms accession means that the European Union reaffirms the pivotal role played by the Convention’s system for the protection of human rights in Europe – in an enlarged Europe, not only in the European Union – but by acceding to this Convention the European Union puts its weight behind the Strasbourg system, and this is a system of external judicial control in the area of fundamental rights because now we are submitting our legal order fully and formally to that control. This, of course, will enhance the credibility both internally and externally of the EU’s very strong commitment to fundamental rights.
Sur le plan politique, l’adhésion signifie que l’Union européenne réaffirme le rôle pivot qu’endosse le système de la Convention en matière de protection des droits de l’homme en Europe, dans une Europe élargie et non sur le seul territoire de l’Union. En adhérant à cette Convention, l’Union européenne appuie le système de Strasbourg, qui est un système de contrôle judiciaire extérieur dans le domaine des droits fondamentaux, auquel nous soumettons désormais pleinement et formellement notre système juridique. 3. The scope of this Directive shall be progressively extended to the whole conventional rail system, including track access to terminals and main port facilities serving or potentially serving more than one user, except for infrastructure and rolling stock reserved for a strictly local, historical or touristic use or infrastructure which is functionally isolated from the rest of the rail system, and without prejudice to the derogations to the application of TSIs as listed in Article 7.
3. (21) Since a draft reference system of technical rules concerning the current degree of interoperability of the trans-European conventional rail system is being developed as provided for in Article 25 of Directive 2001/16/EC, there is a need to update these technical rules in view of the extension of the scope of that Directive and also taking account of the first group of TSIs to be adopted by 2004.

Once this Directive enters into force, the Committee may discuss any matter relating to the interoperability of the trans-European conventional rail system, including questions relating to interoperability between the trans-European rail system and the rail system of third countries.

‘trans-European conventional rail system’ means the structure, as described in Annex I, composed of lines and fixed installations, of the trans-European transport network, built or upgraded for conventional rail transport and combined rail transport, plus the rolling stock designed to travel on that infrastructure.

In accordance with Articles 154 and 155 of the Treaty, this Directive sets out to establish the conditions to be met to achieve interoperability within the Community territory of the trans-European conventional rail system, as described in Annex I. These conditions concern the design, construction, putting into service, upgrading, renewal, operation and maintenance of the parts of this system put into service after the date of entry into force of this Directive.
Conformément aux articles 154 et 155 du traité, la présente directive a pour objet d'établir les conditions qui doivent être satisfaites pour réaliser, au sein du territoire communautaire, l'interopérabilité du système ferroviaire transeuropéen conventionnel tel qu'il est décrit à l'annexe I.
