Given that on 9 June 2008 the Council had received, from the French authorities, new information, namely, the judicial inquiry opened on 9 April 2001 in relation to 17 alleged members of the PMOI and the judicial investigation of 24 persons, warranting, according to those authorities, their request for the PMOI to be included in the list referred to in Article 2(3) of Regulation No 2580/2001, the Council ought, in order to guarantee the effectiveness of the sanctions, to have avoided any interruption of the freezing of funds and, therefore, to have adopted as swiftly as possible a new decision in

Étant donné que le Conseil avait reçu, le 9 juin 2008, de la part des autorités françaises, de nouveaux éléments, à savoir l’information judiciaire ouverte le 9 avril 2001 contre 17 membres présumés de la PMOI et la mise en examen de 24 personnes, justifiant, selon ces autorités, leur demande d’inscription de la PMOI dans la liste visée à l’article 2, paragraphe 3, du règlement n° 2580/2001, le Conseil aurait dû, pour assurer l’efficacité des sanctions, éviter toute interruption du gel des fonds et, par conséquent, adopter, le plus rapidement possible, une nouvelle décision incluant la PMOI dans cette liste.
