B. considérant que le 13 mars 2015, l'ancien président et chef du parti démocratique maldivien de l'opposition, Mohamed Nasheed, accusé de "terrorisme", a été condamné à 13 ans de prison pour avoir ordonné, en janvier 2012, la détention militaire du juge en chef du tribunal pénal, Abdulla Mohamed, pendant sa présidence;

B. whereas, on 13 March 2015, former President Mohamed Nasheed was sentenced to 13 years under the Maldives’ Anti-Terrorism Act 1990 on the charge that he had ordered, as then president of the country, the unlawful detention of Criminal Court Chief Judge Abdullah Mohamed in 2012; whereas Mr Nasheed has denied this charge;
B. considérant que, le 13 mars 2015, l'ancien président Mohamed Nasheed a été condamné à treize ans de prison en vertu de la loi antiterroriste de 1990 des Maldives parce qu'il aurait ordonné, en tant que président du pays, l'arrestation illégale du juge en chef du tribunal pénal, Abdullah Mohammed, en 2012; que M. Nasheed a rejeté cette accusation;

WHEREAS section 24.1 of that Act provides that the associate chief judge of the Court of Québec who is responsible for municipal courts shall exercise, under the authority of the chief judge of the Court of Québec, the functions exercised by the chief judge in respect of municipal judges and municipal courts pursuant to the Act respecting municipal courts, in addition to the functions assigned to the associate chief judge by the Courts of Justice Act (R.S.Q., c. T-16);
ATTENDU QUE l’article 24.1 de cette loi prévoit que le juge en chef adjoint de la Cour du Québec responsable des cours municipales exerce, sous l’autorité du juge en chef de la Cour du Québec, les fonctions de juge en chef prévues par la Loi sur les cours municipales à l’égard des juges municipaux et des cours municipales, en outre de celles qui lui sont attribuées par la Loi sur les tribunaux judiciaires (L.R.Q., c. T-16);

(2) Notwithstanding the Judges Act, the Chief Judge and the Associate Chief Judge of the District Court of Ontario shall, on the coming into force of this subsection, be deemed to have made an election in accordance with section 32 of that Act for the purposes of subsection 43(2) of that Act, and if, at the time of their resignation, removal or attaining the age of retirement, they were holding office as judge of the Ontario Court (General Division), the annuity payable to them under section 42 of that Act shall be an annuity equal to two thirds of the salary annexed to the office of chief judge of a county court or, if there is no such office at that time, two thirds of the result obtained by subtracting five thousand dollars from the salary annexed at that time to the office of Chief Justice of the Ontario Court.
(2) Par dérogation à la Loi sur les juges, le juge en chef et le juge en chef adjoint de la Cour de district de l’Ontario sont, à l’entrée en vigueur du présent paragraphe, réputés avoir exercé, pour l’application du paragraphe 43(2) de cette loi, la faculté visée à l’article 32 de la même loi; ils ont dès lors droit, au titre de l’article 42 de la même loi, à une pension égale aux deux tiers du traitement prévu pour le poste de juge en chef d’une cour de comté si, au moment de la cessation de leurs fonctions par mise à la retraite d’office, démission ou révocation, ils occupaient un poste de juge à la Cour de l’Ontario (Division générale). Toutefois, si à ce moment ce poste n’existe plus, ils ont droit aux deux tiers de la différence entre le traitement prévu pour le poste de juge en chef de la Cour de l’Ontario et cinq mille dollars.

551.1 (1) On application by the prosecutor or the accused or on his or her own motion, the Chief Justice or the Chief Judge of the court before which a trial is to be or is being held or the judge that the Chief Justice or the Chief Judge designates may, if he or she is of the opinion that it is necessary for the proper administration of justice, appoint a judge as the case management judge for that trial at any time before the jury selection, if the trial is before a judge and jury, or before the stage at which the evidence on the merits is presented, if the trial is being heard by a judge without a jury or a provincial court judge.
551.1 (1) Sur demande du poursuivant ou de l’accusé ou de sa propre initiative, le juge en chef de la cour devant laquelle se tient ou doit se tenir un procès ou le juge qu’il désigne peut, s’il est d’avis que cela servirait la bonne administration de la justice, nommer relativement au procès un juge à titre de juge responsable de la gestion de l’instance, à tout moment avant la constitution du jury, s’il s’agit d’un procès devant jury, ou avant le stade de la présentation de la preuve sur le fond, s’il s’agit d’un procès devant un juge sans jury ou un juge de la cour provinciale.

In order to help create an independent and impartial judiciary, is pleased with the substantial efforts to further reform the judiciary, in particular with the adoption of the revised judicial reform action plan; welcomes the progress in further reducing the backlog of cases, especially those where proceedings last more than three years, and rationalising the court system by setting up larger courts, county courts and commercial courts as well as by arranging for judges to specialise; notes the positive steps, including with regard to the State Judicial Council, the independence of the Judicial Academy and the establishment of the school for judicial officers, to reinforce the independence of judicial appointments and to improve career development and the disciplinary liability of chief judges as well as the adoption of general safeguards for enhanced independence of the judiciary;
