IN-CONTEXT TRANSLATIONS

10. Welcomes the constitutional amendments aimed at strengthening the independence of the judiciary by reducing political influence on the appointment of prosecutors and judicial officials at all levels through more transparent and merit-based procedures, and specifically by electing the Supreme State Prosecutor; takes note, however, of the Ombudsman’s initiative for assessing the constitutionality of these amendments and of the provisions of the law on the Constitutional Court concerning the election of Constitutional Court Judges; calls on the competent authorities to establish a solid track record of disciplinary proceedings and to ensure timely justice, together with the unification of jurisprudence; calls for further legislative and other measures to be taken and implemented in order to diminish the politicisation of the judiciary in practice, including through objective evaluation of judicial performance, clear demonstration of judicial accountability in line with the recommendations of the Venice Commission, and the guaranteeing of merit-based promotions; underlines also the need to ensure the independence of misdemeanour courts from the executive branch;

(14) To reflect the increasing mobility of couples during their married life and facilitate the proper administration of justice, the rules on jurisdiction in this Regulation provide that matters of matrimonial property regimes, including liquidation of the regime as a result of divorce, legal separation or marriage annulment, are to be dealt with by the courts of the Member State having jurisdiction to deal with the divorce, separation or marriage annulment proceedings under Council Regulation (EC) No 2201/2003 concerning jurisdiction and the recognition and enforcement of judgments in matrimonial matters and the matters of parental responsibility, repealing Regulation (EC) No 1347/2000, if the jurisdiction of the courts concerned has been expressly or in some other manner recognised by the spouses .
(14) Afin de tenir compte de la mobilité croissante des couples au cours de leur vie maritale et de favoriser une bonne administration de la justice, les règles de compétence contenues dans le présent règlement prévoient que les questions relatives au régime matrimonial, en ce compris sa liquidation résultant d'une procédure de divorce, de séparation ou d'annulation du mariage, doivent être traitées par les juridictions de l'État membre compétentes selon le règlement (CE) n° 2201/2003 du Conseil relatif à la compétence, la reconnaissance et l'exécution des décisions en matière matrimoniale et en matière de responsabilité parentale abrogeant le règlement (CE) n° 1347/2000 pour connaître de cette procédure de divorce, de séparation ou d'annulation du mariage, si la compétence des juridictions en question a été reconnue expressément ou d'une autre manière par les époux .
