The new crimes concern damaging a portion of the habitat of a listed species at risk. I am speaking for oil and gas, mining, forestry and agriculture, but to me as a grazer of cattle, that could mean that if I am clearing brush to build a new fence or to repair an existing one, and that brush happens to be the habitat of a species at risk, a bird or whatever, and I am not aware of that, under the strict liability provisions of clauses 97 and 98 — with these horrendous fines and incarceration — I have to prove that I did not do it, and it is a heavy burden.
