Definition: This block contains a wide variety of disorders that differ in severity and clinical form but that are all attributable to the use of one or more psychoactive substances, which may or may not have been medically prescribed. The third character of the code identifies the substance involved, and the fourth character specifies the clinical state. The codes should be used, as required, for each substance specified, but it should be noted that not all fourth character codes are applicable to all substances. Identification of the psychoactive substance should be based on as many sources of information as possible. These include self-report data, analysis of blood and other body fluids, characteristic physical and psychological symptoms, clinical signs and behaviour, and other evidence such as a drug being in the patient's possession or reports from informed third parties. Many drug users take more than one type of psychoactive substance. (Le document est déposé) Question n 182 Mme Chris Charlton: En ce qui concerne le soutien en matière de santé mentale dans les prisons et autres établissements de détention administrés par le Service correctionnel du Canada (SCC): a) quel progrès a-t-on accompli depuis 2004 dans la mise en œuvre de la Stratégie en matière de santé mentale du SCC; b) quelles sont les mesures en place pour l'exécution des initiatives sur la Santé mentale dans la collectivité et sur la Santé mentale en établissement sur les cinq prochaines années; c) quelles sont les mesures en place pour donner suite aux recommandations formulées dans le rapport annuel 2008-2009 du Bureau de l'enquêteur correctionnel; d) combien d'argent en tout le SCC a-t-il alloué à tous les types d'appui en matière de santé mentale pour l'exercice financier à venir, ventilé par type de programme; e) quel pourcentage des fonds totaux du SCC est-il alloué à l'appui en matière de santé mentale pour le prochain exercice financier; f) quel pourcentage des fonds totaux du SCC est-il alloué à la sécurité, à la gestion du risque et au contrôle pour le prochain exercice financier; g) combien de délinquants ont-ils accès à des unités de soins intermédiaires en santé mentale dans la région où ils sont incarcérés; h) quels sont les processus pour examiner l'efficacité des programmes de santé mentale et relever les écarts dans les services; i) à quelles recommandations ces examens ont-ils donné lieu au cours des deux dernières années; j) quel progrès a-t-on accompli dans l’examen indépendant des cas d'isolement de longue durée; k) quel progrès a-t-on accompli dans la création d'une série d'indicateurs de rendement mesurables pour évaluer la réponse du SCC aux problèmes de santé mentale des délinquants; l) quelles lignes directrices le SCC fournit-il au personnel opérationnel sur le recours à l'isolement pour les délinquants qui ont des problèmes de santé mentale; m) quel progrès le Comité national de gestion de la p ...

According to the Czech authorities, a market economy investor would have interpreted this earlier double rejection by the CSC as confirming its expectation that INH and LNM were trying, through these deficiencies identified by the CSC in the expert reports, to undervalue the company in order to pay the lowest possible price for the shares they planned to buy back.
D’après les autorités tchèques, un investisseur en économie de marché aurait interprété le double refus antérieur de la KCP comme une confirmation de la supposition selon laquelle INH et LNM ont tenté, par le biais des insuffisances que la KCP a décelées dans l’expertise, de sous-évaluer la société pour pouvoir payer le prix le plus bas possible pour les actions qu’elles prévoyaient de racheter.

regarding the fact that the price was approved by the CSC, the Czech authorities stress that, contrary to the hypothesis of the Commission expressed in the opening decision, the CSC assesses the bid on the basis of the applicable law and its internal methodology on ‘Expert reports for setting the price of participating securities within a mandatory take-over bid and within a public offer to purchase shares’ and it does not have the competence to set the price of the shares itself or to replace the expert valuation report by its own analysis.
en rapport avec l’approbation du prix par la KCP, les autorités tchèques soulignent que, contrairement à l’hypothèse formulée par la Commission dans la décision d’ouvrir la procédure, la KCP évalue l’offre sur la base des dispositions légales applicables et de sa méthodologie interne «Expertises effectuées pour les offres obligatoires de reprise et les offres publiques de contrats d’achat de titres de participation» et n’est pas habilitée à fixer elle-même le prix des actions, ni à remplacer une expertise par sa propre analyse.

The Commission concludes that the combination of the four foregoing elements helps to explain why, at the time of the Government purchase, the price of CZK 550 proposed by INH within the framework of the buy-back operation and endorsed by the CSC would not have been seriously taken into account by a market economy investor and could not constitute a serious bargaining tool to force the seller to decrease its price.
La Commission est arrivée à la conclusion que la combinaison des quatre éléments précités permettait d’expliquer pourquoi, au moment de l’achat gouvernemental, le prix de 550 CZK soumis par INH et approuvé par la KCP dans le cadre du rachat ne pouvait être réellement pris en considération par un investisseur en économie de marché et ne pouvait constituer un instrument de négociation sérieux pour forcer le vendeur à baisser son prix.

The Commission accepts the third element put forward by the Czech authorities, namely that a market economy investor would have interpreted the prior double rejection by the CSC as confirming its expectation that INH and LNM (the majority shareholder of INH, which is the driving force behind this operation since it will buy from INH the shares that the company has bought back) were trying to undervalue the company in order to pay the lowest possible price for the shares they wished to buy back.
La Commission admet le troisième élément avancé par les autorités tchèques, à savoir qu’un investisseur en économie de marché aurait interprété le double refus antérieur de la KCP comme une confirmation de la supposition selon laquelle INH et LNM (actionnaire majoritaire d’INH, qui est l’élément moteur de cette opération, parce qu’il acquerra auprès d’INH les actions que la société a rachetées) ont tenté de sous-évaluer la société INH dans l’espoir de pouvoir racheter les actions souhaitées au prix le plus bas possible.
