4. For the purposes of this Directive, ‘terrorist financing’ means the provision or collection of funds, by any means, directly or indirectly, with the intention that they should be used or in the knowledge that they are to be used, in full or in part, by an individual terrorist or a terrorist organisation, or in order to carry out any of the offences within the meaning of Articles 1 to 4 of Council Framework Decision 2002/475/JHA of 13 June 2002 on combating terrorism, as amended by Council Framework Decision 2008/919/JHA of 28 November 2008.
4. Aux fins de la présente directive, on entend par "financement du terrorisme" le fait de fournir ou de réunir des fonds, par quelque moyen que ce soit, directement ou indirectement, dans l'intention de les voir utilisés ou en sachant qu'ils seront utilisés, en tout ou en partie, par un individu ou une organisation terroristes ou en vue de commettre l'une quelconque des infractions visées aux articles 1 à 4 de la décision-cadre 2002/475/JAI du Conseil du 13 juin 2002 relative à la lutte contre le terrorisme, telle que modifiée par la décision-cadre 2008/919/JAI du Conseil du 28 novembre 2008.

3. Notwithstanding the time limit laid down in the first subparagraph of paragraph 2, where an investor or any other person entitled to or having an interest in investment business has been charged, in relation to money that is the subject of this Directive, with an offence arising out of or in relation to money laundering as defined in Article 1(2) of Directive 2005/60/EC, arising out of conduct that is prohibited under Directive 2003/6/EC, or relating to the direct or indirect financing of terrorist groups which is the subject of Council Recommendation of 9 December 1999 on cooperation in combating the financing of terrorist groups, the investor-compensation scheme may suspend any payment pending the judgment of the court or determination of a competent authority.“.
3. (a) "public provocation to commit a terrorist offence" means the distribution, or otherwise making available, of a message to the public, with the intent to incite the commission of one of the acts listed in Article 1(1)(a) to (h), where such conduct, whether or not directly advocating terrorist offences, causes a danger that one or more such offences may be committed;

The Commission must clarify that although it remains true that directing a terrorist group and participating in its activities are not specifically criminalised in Sweden, its widely formulated provisions on attempt, preparation, conspiracy and complicity may allow the prosecution of both leaders and participants in a terrorist group.

Regarding penalties, it introduces a principle of "aggravating circumstance" by providing that "terrorist offences" and certain offences linked to terrorism must be punishable by custodial sentences heavier than those imposable under national law for such offences in the absence of a terrorist intent, it sets the minimum level of the maximum penalty at 15 years for directing a terrorist group and 8 years for participation in a terrorist group, it enumerates a series of penalties that can be imposed on bodies corporate (in particular exclusion from entitlement to public benefits or aid, temporary or permanent disqualification from the practice of commercial activities, placing under judicial supervision, judicial winding-up order and closure of establishments), it provides for a system of "repentis" by providing for specific circumstances in which Member States may reduce prison sentences where the terrorist renounces terrorist activity or provides the administrative or judicial authorities with information.

[17] 7 Framework Decision 2002/475/JHA creates offences of directing a terrorist group and of different forms of participation in the activities of a terrorist group (by supplying information or material resources, or by funding its activities in any way, with knowledge of the fact that such participation will contribute to the criminal activities of the terrorist group), and provides also for inciting, aiding or abetting, and in most cases attempting these offences.

Offences relating to a terrorist group must be punishable by a maximum sentence of no less than eight years for participation in the activities of such groups and fifteen years for the offence of directing a terrorist group.
