It must admittedly be observed that neither the Statute of the Court of Justice nor the Rules of Procedure of the Civil Service Tribunal, nor indeed the Rules of Procedure of the Court of Justice or those of the General Court, provide for the imposition of a sanction in the case of refusal to comply with
such an order, the only possible response to a refusal bei
ng for the court to draw the appropriate inferences from that refusal in the decision closing the case (see, to that effect, Case 155/78 M. v Commission [1980] ECR 1797, paragraphs 2
0 and 21), ...[+++] which is what the Civil Service Tribunal did in the judgment under appeal.
À cet égard, il doit, certes, être observé que ni le statut de la Cour, ni le règlement de procédure du Tribunal de la fonction publique, à l’instar, par ailleurs, des règlements de procédure de la Cour et du Tribunal, ne prévoient la possibilité d’infliger une sanction en cas de non-obtempération à une telle ordonnance, la seule réaction possible face à un refus étant que la juridiction en tire les conséquences dans la décision mettant fin à l’instance (voir, en ce sens, arrêt de la Cour du 10 juin 1980, M./Commission, 155/78, Rec. p. 1797, points 20 et 21), ce que le Tribunal de la fonction publique a fait dans l’arrêt attaqué.
