TRADUCTIONS EN CONTEXTE

5. Strongly denounces the judicial decision of 4 June 2013 by the Cairo Criminal Court to sentence 43 Egyptian and foreign NGO workers to jail, to close the local branches of the five foreign NGOs concerned and to confiscate their assets; considers that this politically motivated sentence, which criminalises the legitimate work of foreign organisations in Egypt, is an unacceptable attack on freedom of association and expression and constitutes a serious blow to international and EU efforts to support Egypt in its political transition; urges the Egyptian authorities to put an immediate end to all the forms of harassment and intimidation to which independent NGOs are subjected in the country and, especially, to drop all criminal charges against NGO workers;
5. dénonce vivement la décision de justice prise le 4 juin 2013 par la cour pénale du Caire, qui a condamné 43 membres d'ONG égyptiennes et étrangères à la détention, de fermer les sections locales des 5 ONG étrangères concernées et de confisquer leurs biens; estime que ce jugement à connotation politique, qui érige en délit le travail légitime d'organisations étrangères en Égypte, constitue une attaque inacceptable contre la liberté d'expression et d'association dans le pays et un coup grave porté contre les efforts de la communauté internationale et de l'Union européenne pour soutenir l'Égypte dans sa transition politique; demande instamment aux autorités égyptiennes de mettre fin sans délai à toutes les formes de harcèlement et d'intimidation que subissent les ONG indépendantes dans le pays et, en particulier, d'abandonner toutes les poursuites pénales à l'encontre de travailleurs de ces ONG;

Expresses its solidarity with and full support of international and domestic NGOs that contribute to building deep and sustainable democracy in Egypt; is deeply concerned about the recent Cairo court rulings that sentenced 43 foreign and Egyptian NGO workers to up to five years in prison for civil society activities and ordered the closure and the confiscation of assets of local branches of five international NGOs; calls on the Egyptian government and authorities to put an immediate end to all forms of restrictions, harassment and intimidation against international and domestic NGOs in the country, in particular by dropping all criminal charges against NGO workers and avoiding the criminalisation of NGO activities by using judicial procedures as a political tool against them;
5. exprime sa solidarité et son soutien total à toutes les ONG internationales et nationales qui contribuent à l'édification d'une démocratie solide et durable en Égypte; est profondément préoccupé par le jugement rendu récemment par un tribunal du Caire, qui a condamné 43 travailleurs d'ONG étrangères et égyptiennes à des peines allant jusqu'à cinq ans de prison pour avoir mené des activités de la société civile, et a ordonné la fermeture et la confiscation des avoirs des antennes locales de cinq ONG internationales; invite le gouvernement et les autorités égyptiennes à mettre immédiatement un terme à toutes les formes de restrictions, de harcèlement et d'intimidation contre les ONG internationales et nationales dans le pays, notamment en supprimant toutes les charges pénales à l'encontre des travailleurs d'ONG et en évitant la criminalisation des activités des ONG par l'utilisation de procédures judiciaires en tant qu'outil politique à leur encontre;

Urges the Egyptian authorities to put an immediate end to all the forms of harassment and intimidation to which independent civil society organisations are subjected and, especially, to drop all criminal charges against civil society workers; strongly supports the independent civil society in Egypt as part of the commitments of the new European Neighbourhood Policy;

Underlines the importance of civil society in any democratic society and calls in this regard on the Egyptian authorities to fully associate and consult with civil society organisations in the process of democratic transition, including on the electoral process and to stop all forms of harassment or intimidations to which civil society organisations are currently subjected whether direct or indirect, especially to drop all criminal charges and to end the media campaign against NGOs; calls on the Egyptian authorities to adopt a new association law in accordance with International Human Rights Standards and in close consultation with NGOs and human rights groups;

Lengthy criminal proceedings, particularly when these are ultimately dropped, may also substantially delay disciplinary sanctions, as the outcome of criminal prosecutions for the same facts must, in cases involving EU staff, be awaited [19].

If the offender fulfils the conditions of the agreement, criminal proceedings are dropped; if not proceedings take their normal course, up to and possibly including conviction.
