It is submitted that the case of Pringle (2) upon which the General Court relied (3), decides that whereas the Commission and the ECB solely commit the ESM (4), nevertheless at inter alia (5) paragraph 164 of that case the court observed that the ‘tasks allocated to the Commission by the ESM Treaty enable it, as provided in 13(3) and 13(4) of that treaty, to ensure that the memoranda of understanding concluded by the ESM are consistent with EU law’ and at paragraph 174 that ‘under Article 13(3) of the ESM Treaty the MoU which is to be negotiated with the Member State requesting stability support must be fully consistent with EU law’.

In line with the capital structure of entities affiliated to a central body, for the purposes of this Regulation, the Board, or, where relevant, the national resolution authorities, should not be obliged to draw up separate resolution plans solely on the grounds that the central body to which those entities are affiliated is under direct supervision of the ECB.

The European Council in December finally gave the green light for the Banking Union, whereby we shall have the ECB as the sole supervisor of 'systemic' banks as from 2015, with its supervision being extended to other banks by 2017.

3.2. Whilst the ECB notes the definition of ‘payment service provider’ in Article 2(5) of the proposed regulation, it also notes that, pursuant to recital 8 of the proposed regulation and recital 35 of the proposed directive, it is not the Union legislators’ intention to include within the scope of the regulation persons who provide ‘credit or financial institutions solely with a message or other support systems for transmitting funds or with clearing and settlement systems’ such as the ECB operated TARGET2 system.
3.2. Tout en notant la définition de «prestataire de services de paiement» à l’article 2, paragraphe 5, du règlement proposé, la BCE observe par ailleurs que, selon le considérant 8 du règlement proposé et le considérant 35 de la directive proposée, les législateurs de l’Union n’ont pas l’intention de soumettre au règlement des personnes qui «ne fournissent à un établissement de crédit ou à un établissement financier qu’un service de messagerie, d’aide au transfert de fonds ou de compensation et de règlement» tel que le système TARGET2, géré par la BCE.

The Court states, inter alia, that the duties conferred on the Commission and ECB within the ESM Treaty do not entail any power to make decisions of their own and that the activities pursued by those two institutions within the ESM Treaty solely commit the ESM.
La Cour souligne notamment que les fonctions confiées à la Commission et à la BCE dans le cadre du traité MES ne comportent aucun pouvoir décisionnel propre et que les activités exercées par ces deux institutions dans le cadre du même traité n’engagent que le MES.

I hope that, with such renewed commitment to gender balance, Parliament will base its final decision on the current candidate for the ECB executive board on the sole criteria of professional qualification and experience.
