Article 15(7) of Protocol No 4 to the Euro-Mediterranean Agreement establishing an association between the European Communities and their Member States, of the one part, and the Kingdom of Morocco, of the other part (1), (‘the Agreement’), as amended by Decision No 1/2010 of the EU-Morocco Association Council of 23 August 2010 (2), allows drawback of, or partial exemption from, customs duties or charges with equivalent effect, subject to certain conditions, until 31 December 2012.

Do Article 41(1) of the Additional Protocol of 23 November 1970 to the Agreement of 12 September 1963 establishing an Association between the European Economic Community and Turkey for the transitional stage of the Association (AP) and/or Article 13 of Decision No 1/80 of the EEC-Turkey Association Council of 19 September 1980 (Decision No 1/80) preclude a provision of national law which was introduced for the first time after the abovementioned provisions had come into force and which makes the first entry of a member of the family of a Turkish national who enjoys the legal status under Article 6 of Decision No 1/80 conditional on the requirement that, prior to entry, the family member can demonstrate the ability to make himself or herself understood, in a basic way, in the German language?
L’article 41, paragraphe 1, du protocole additionnel du 23 novembre 1970 relatif aux mesures à prendre au cours de la phase transitoire de l’association créée par l’accord du 12 septembre 1963 entre la Communauté économique européenne et la Turquie (ci-après le «protocole additionnel») et/ou l’article 13 de la décision no 1/80 du conseil d’association, du 19 septembre 1980, relative au développement de l’association (ci-après la «décision no 1/80») s’opposent-ils à une disposition de droit national qui, postérieurement à leur entrée en vigueur, prévoit que, pour pouvoir entrer pour la première fois sur le territoire de la République fédérale d’Allemagne, le membre de la famille d’un ressortissant turc bénéficiant du statut conféré par l’article 6 de la décision no 1/80 doit prouver au préalable qu’il peut s’exprimer en allemand avec des mots simples?

On the basis of Directives 88/661/EEC, 89/361/EEC, 90/427/EEC, 91/174/EEC, 94/28/EC and 2009/157/EC, the Commission, after consulting Member States through the Standing Committee on Zootechnics established in accordance with Council Decision 77/505/EEC , adopted a number of Decisions laying down species-specific criteria for the approval or recognition of breeding organisations and breeders' associations, for the entry of breeding animals in herd-books, flock-books and stud-books, for the acceptance of purebred breeding animals of the ovine and caprine species for breeding and artificial insemination, for performance testing and genetic evaluation of breeding animals of the bovine, porcine, ovine and caprine species, and for the establishment of pedigree or zootechnical certificates for trade in breeding animals and their germinal products.
À partir des directives 88/661/CEE, 89/361/CEE, 90/427/CEE, 91/174/CEE, 94/28/CE et 2009/157/CE, et après consultation des États membres dans le cadre du comité zootechnique permanent établi par la décision 77/505/CEE du Conseil , la Commission a adopté plusieurs décisions fixant des critères par espèces en ce qui concerne l'agrément ou la reconnaissance officielle des organisations d'élevage et des associations d'éleveurs, l'inscription dans les livres généalogiques d'animaux reproducteurs, l'admission de reproducteurs de race pure des espèces ovine et caprine à la reproduction et à l'insémination artificielle, le contrôle des performances et l'évaluation génétique des animaux reproducteurs des espèces bovine, porcine, ovine et caprine ainsi que l'établissement de certificats généalogiques ou zootechniques aux fins des échanges d'animaux reproducteurs et de leurs produits germinaux.

Where the Commission, empowered by a Council Regulation, such as Regulations 19/65/EEC, (EEC) No 2821/71, (EEC) No 3976/87, (EEC) No 1534/91 or (EEC) No 479/92, to apply Article 81(3) of the Treaty by regulation, has declared Article 81(1) of the Treaty inapplicable to certain categories of agreements, decisions by associations of undertakings or concerted practices, it may, acting on its own initiative or on a complaint, withdraw the benefit of such an exemption Regulation when it finds that in any particular case an agreement, decision or concerted practice to which the exemption Regulation applies has certain effects which are incompatible with Article 81(3) of the Treaty.

Si la Commission, en vertu de la compétence que lui confère un règlement du Conseil, tel que les règlements n° 19/65/CEE, (CEE) n° 2821/71, (CEE) n° 3976/87, (CEE) n° 1534/91 ou (CEE) n° 479/92, pour appliquer par voie de règlement les dispositions de l'article 81, paragraphe 3, du traité, a déclaré l'article 81, paragraphe 1, inapplicable à certaines catégories d'accords, de décisions d'associations d'entreprises ou de pratiques concertées, elle peut d'office ou sur plainte retirer le bénéfice d'un tel règlement d'exemption lorsqu'elle estime dans un cas déterminé qu'un accord, une décision ou une pratique concertée visé par ce règlement d'exemption produit néanmoins des effets qui sont incompatibles avec l'article 81, paragraphe 3, du traité.
