For purposes of determining whether an institution is failing or likely to fail, the competent authority should consider the valuation provided for in Chapter II of this Regulation, where already available and should take into account the guidelines issued by the European Banking Authority (EBA) pursuant to Article 32(6) of Directive 2014/59/EU which aim at promoting convergence of practices in relation to the determination of such resolution condition.
Afin de déterminer si un établissement se trouve en situation de défaillance avérée ou prévisible, l'autorité compétente devrait tenir compte de la valorisation visée au chapitre II du présent règlement si elle est déjà disponible, ainsi que des orientations émises par l'Autorité bancaire européenne (ABE) en vertu de l'article 32, paragraphe 6, de la directive 2014/59/UE pour favoriser la convergence des pratiques en ce qui concerne l'appréciation de cette condition de déclenchement de la procédure de résolution.

(80)The Commission should be empowered to adopt delegated acts in accordance with Article 290 of the Treaty on the Functioning of the European Unionin order to: specifythe definitions of "critical functions" and "core business lines", specify the circumstances when an institution is failing or likely to fail specify the circumstances when the asset separation tool should be applied specify the liabilities excluded from the scope of application of the bail-in tool, specify the circumstances when exclusion from the bail-in tool is necessary to ensure the continuation of critical operations and core business lines, specify the criteria for the determination of the minimum amount of eligible liabilities required from institutions for the purposes of the bail in tool, specify the circumstances when, in application of the bail-in tool, existing shares should be cancelled and liabilities should be converted into shares, specify the circumstances when third country resolution proceedings should not be recognised, further specify the conditions under which it should be considered that the target level of the financing arrangements has significantly deviated from the initial level, adopt criteria aimed at adjusting the contributions to the financing arrangements to the risk profile of institutions, define obligations aimed at ensuring the effective payment of the contributions to the financing arrangements and specify the conditions for the mutual borrowing between national financing arrangements.

Strongly rejects the systematic violence and the recurrent acts of harassment suffered by the Sakharov Prize laureates the ‘Damas de Blanco’ (‘Ladies in White’) when they peacefully demonstrate and ask for the release of their relatives, incarcerated in Cuba for more than five years now; calls on its President to reiterate to the Cuban authorities its request that Oswaldo Payá, winner of the Sakharov Prize in 2002, be permitted, in accordance with the invitation extended to him by the European institutions to appear before them in person and explain the current political situation in Cuba; further calls on its President to express to the Cuban authorities Parliament's strong wish and determination to welcome, in the coming weeks, the ‘Damas de Blanco’ to one of Parliament's places of work for the official presentation to them of the 2005 Sakharov Prize;

Is the reference to the Court of Justice of the European Communities for a ruling on whether Article 8a of Council Directive 80/987/EEC of 20 October 1980 on the approximation of the laws of the Member States relating to the protection of employees in the event of the insolvency of their employer, (1) as amended by Directive 2002/74/EC of the European Parliament and of the Council of 23 September 2002, (2) which provides, in paragraph 1 thereof, that when an undertaking with activities in the territories of at least two Member States is in a state of insolvency, the institution responsible for meeting employees’ outstanding claims is to be that in the Member State in whose territory they work or habitually work and, in paragraph 2 thereof, that the extent of employees’ rights is to be determined by the law governing the competent guarantee institution, is to be interpreted as designating the competent institution to the exclusion of any other, or whether, having regard to the purpose of the Directive, which is to strengthen the rights of workers exercising their right to freedom of movement, and to the first paragraph of Article 9 of the Directive, under which the Directive is not to affect the option of Member States to apply or introduce laws, regulations or administrative provisions which are more favourable to employees, it is to be interpreted as not depriving the employee of the right to take advantage, in the place of that institution’s guarantee, of a more favourable guarantee from the institution with which his employer is insured and to which it makes contributions under national law?

With regard to the organisation of the Institute, the Council, the European Parliament and the Commission state that the management structure, and in particular the number of representatives of the Member States on the Management Board, is determined by reference to the specific nature of the European Institute for Gender Equality and does not therefore constitute a precedent for other agencies in the future.
