IN-CONTEXT TRANSLATIONS

The EU welcomes the adoption of the resolution by the special session of the UN Human Rights Council on 29 April on the situation in Syria, including the sending by the UN Commissioner for Human Rights of a fact-finding mission to investigate all violations of international human rights and to establish facts.
L'UE se félicite de l'adoption, lors de la session extraordinaire tenue le 29 avril par le Conseil des droits de l'homme des Nations unies, de la résolution concernant la situation en Syrie, qui demande notamment au Haut Commissariat aux droits de l'homme de dépêcher une mission d'information pour enquêter sur toutes les violations des droits de l'homme et établir les faits.

Recalls that respect for the core values of the EU and protection and promotion of human rights and fundamental freedoms constitute common ground in the Union’s relations with third countries, and stresses that the EU is bound by the Charter also in this respect; in this regard, recalls that the promotion of democracy and of the rule of law goes hand in hand with the respect, protection and promotion of human rights and fundamental freedoms; underlines the fact that, within the new institutional structure of the EU, the European External Action Service (EEAS) can only offer an opportunity to enhance coherence and effectiveness in the sphere of external policy efforts to promote human rights and democracy if a human-rights-based approach to the service’s structure, resources and activities is endorsed; emphasises that the Union plays a leading role in the promotion of human rights in the world; in this regard, calls on the EU to ensure the effectiveness of the human rights clauses in the international agreements and to take into account the principles of the Charter when entering into agreements with third countries, as well as to maintain coherence between its internal and external human rights policy;
rappelle que le respect des valeurs fondamentales de l'UE et la protection et la promotion des droits de l'homme et des libertés fondamentales constituent un dénominateur commun des relations de l'Union avec les pays tiers, et souligne que la Charte est applicable dans ce contexte; rappelle à cet égard que la promotion de la démocratie et de l'État de droit va de pair avec le respect, la protection et la promotion des droits de l'Homme et des libertés fondamentales; souligne que, à l’intérieur de la nouvelle structure institutionnelle de l’UE, le Service européen pour l’action extérieure (SEAE) ne peut permettre d’accroître la cohérence et l’efficacité dans le domaine de la politique extérieure afin de promouvoir les droits de l'homme et la démocratie que si ce service adopte une approche fondée sur les droits de l’homme de sa structure, de ses ressources et de son activité; souligne que l'Union joue un rôle pionnier dans la promotion des droits de l'homme dans le monde; invite à cet égard l'UE à veiller à ce que les dispositions des accords internationaux relatives aux droits de l'homme soient effectivement appliquées, à garder à l'esprit les principes inscrits dans la Charte lorsqu'elle passe des accords avec des pays tiers et à assurer la cohérence entre ses politiques interne et externe relatives aux droits de l'homme;

Recognises attempts by the Council and the Commission to organise a second round of the European Union-Uzbekistan dialogue on human rights in May 2008 and commends the Commission on its efforts to organise a civil society seminar on media expression in the margins of the dialogue, possibly in Tashkent; points out once again that the holding of a dialogue on human rights and experts' meetings on the 2005 Andijan massacre do not in themselves constitute progress and cannot be used as a reason for the lifting of sanctions; notes that the absence of an independent international inquiry into the Andijan massacre and the lack of any improvement in the human rights situation in Uzbekistan — these being the conditions laid down by the European Union for the lifting of sanctions — have logically led to the sanctions against Uzbekistan being extended; welcomes the fact that the conclusions of the General Affairs and External Relations Council of 15-16 October 2007 have introduced specific conditions which have to be met within a period of six months in order for the visa restriction suspension to be maintained; invites the Council and the Commission to carry out a serious assessment of the impact of the decision to suspend for six months some of the visa restrictions that form part of the European Union sanctions against Uzbekistan, and to review the overall human rights situation in the country; deplores the fact that Uzbekistan has so far failed to deliver any progress in any of these respects; pays tribute to the work done by its Subcommittee on Human Rights in closely monitoring the human rights situation every six months so as to provide the Council with regular parliamentary assessments and recommendations as regards the EU policy to be adopted in this matter; is appalled by the presidential election held on 23 December 2007 in Uzbekistan, which according to the ODIHR was ‘held in a strictly controlled political environment, leaving no room for real opposition, a ...
reconnaît les tentatives du Conseil et de la Commission pour organiser en mai 2008 un second cycle dans le dialogue UE-Ouzbékistan sur les Droits de l'homme et félicite la Commission de ses efforts visant à organiser, éventuellement à Tachkent, en marge de ce dialogue, un séminaire de la société civile sur l'expression des médias; fait une nouvelle fois remarquer que le fait d'accepter un dialogue sur les Droits de l'homme et des réunions d'experts sur le massacre d'Andijan en 2005 ne constitue pas en soi un progrès et ne peut être invoqué comme raison de lever des sanctions; constate que l'absence d'une enquête internationale indépendante sur le massacre d'Andijan et l'absence de toute amélioration de la situation des Droits de l'homme en Ouzbékistan — conditions mises par l'Union à l'allègement des sanctions — ont logiquement conduit à la prorogation des sanctions contre ce pays; se félicite que les conclusions du Conseil «Affaires générales et Relations extérieures» des 15 et 16 octobre 2007 introduisent des conditions particulières qui devront être satisfaites dans un délai de six mois pour que la suspension des restrictions sur les visas soit maintenue; invite le Conseil et la Commission à mener à bien une évaluation rigoureuse de l'effet de la décision de suspendre pour une période de six mois certaines des restrictions de visas qui font partie des sanctions de l'Union envers l'Ouzbékistan et de passer en revue l'ensemble de la situation en matière de Droits de l'homme dans ce pays; regrette que l'Ouzbékistan ait échoué jusqu'à présent à accomplir le moindre progrès sur chacune de ces questions; rend hommage au travail accompli par sa sous-commission «Droits de l'homme» qui surveille étroitement, tous les six mois, la situation des Droits de l'homme de façon à fournir régulièrement au Conseil des évaluations et des recommandations parlementaires sur la politique que l'Union doit suivre en la matière; est consterné par les élections présidentielles du 23 ...

Regrets the fact that only five human rights organisations remain registered in Belarus and that the authorities continually seek to intimidate and control those groups whilst repeatedly refusing applications by other human rights groups to register legally; welcomes the decision of the UN General Assembly in May 2007 to reject Belarus' bid for a seat on the UNHRC, pointing to its poor human rights record; once again urges the Belarus authorities to stop using intimidation, harassment, targeted arrests and politically motivated prosecutions against human rights defenders and civil society activists in Belarus;
déplore le fait que seules cinq organisations des Droits de l'homme restent enregistrées au Belarus et que les autorités cherchent continuellement à intimider et à contrôler ces groupes tout en refusant systématiquement les demandes déposées par d'autres groupes de défense des Droits de l'homme pour être enregistrés légalement; se félicite de la décision de l'Assemblée générale des Nations unies de mai 2007 de rejeter la demande du Belarus de siéger au CDHNU, en soulignant son piètre palmarès en la matière; invite à nouveau instamment les autorités bélarussiennes à cesser tout acte d'intimidation ou de harcèlement, toute arrestation ciblée et toute poursuite pour des motifs politiques à l'encontre des défenseurs des Droits de l'homme et de la société civile au Belarus;

Hopes that those responsible for the assassination of Benazir Bhutto are identified and held responsible as soon as possible; notes the worsening human rights situation in Pakistan throughout 2007, including in particular the threats to the independence of the judiciary and the freedom of the media; with that in mind, condemns the defamation campaign against Iftikhar Mohammad Choudhry, former Chief Justice of Pakistan, as well as the fact that he has been removed from office and placed under house arrest; calls on the Council and the Commission to support the movement for democracy started by the judiciary and the bar, particularly by extending invitations to some of their representatives, including Mr Choudhry; calls for the reinstitution of all deposed judges; notes the adoption of a new Country Strategy Paper for Pakistan and welcomes the mainstreaming of conflict prevention and human rights throughout that document; notes that the first meeting of the European Community-Pakistan Joint Commission was held in Islamabad on 24 May 2007 and stresses the need for human rights to be at the forefront of the agenda for all subsequent meetings;
espère que les responsables de l'assassinat de Benazir Bhutto seront identifiés et inculpés responsables dès que possible; observe la détérioration en 2007 de la situation des Droits de l'homme au Pakistan, y compris, notamment, par les menaces pesant sur l'indépendance de la justice et la liberté des médias; condamne à cet égard la campagne de diffamation menée à l'encontre de Iftikhar Mohammad Choudhry, ex-Président de la Cour suprême, de même que sa destitution et sa mise sous résidence surveillée; demande au Conseil et à la Commission de soutenir le mouvement pour la démocratie mis en place par la magistrature et le barreau, notamment en invitant certains de leurs représentants, dont M. Emphasises once again the importance of making the handbook for the implementation of the Guidelines available to human rights defenders on the ground; encourages COHOM to disseminate translations of the European Union Guidelines for Human Rights Defenders in European Union languages that are the lingua franca in third countries and in key non-European Union languages amongst regional desks and embassies/delegations; welcomes the fact that, so far, translations are available in languages such as Russian, Arabic, Chinese and Farsi but stresses that more translations need to be produced locally; urges European Union Member States to simplify the issue of visas to human rights defenders who are invited to attend events organised within the European Union or who are fleeing worsening security conditions;
souligne une fois encore qu'il est important de mettre le manuel de mise en œuvre des lignes directrices à la disposition des défenseurs des Droits de l'homme sur le terrain; encourage le COHOM à diffuser des traductions des lignes directrices de l'Union européenne à l'intention des défenseurs des Droits de l'homme dans les langues de l'Union qui constituent la langue véhiculaire dans des pays tiers, ainsi que dans des langues majeures autres que celles de l'Union, parmi les bureaux régionaux et les ambassades ou délégations; se réjouit qu'à présent, des traductions soient disponibles en certaines langues, comme le russe, l'arabe, le chinois ou le persan, mais souligne qu'il est nécessaire de faire localement davantage de traductions; presse les États membres de l'Union de simplifier les formalités d'octroi de visas aux défenseurs des Droits de l'homme invités à assister à des événements organisés dans l'Union ou fuyant du fait de conditions de sécurité qui empirent.

It also calls on the government to desist from any further action which could affect the re-establishment of a national consensus on all aspects of governance, human rights and economic development and to invite the UN High Commissioner for human rights and the International Labour Organisation to conduct a fact finding mission in Zimbabwe.
Il demande également au gouvernement de s'abstenir de toute nouvelle action susceptible de compromettre le rétablissement d'un consensus national sur tous les aspects de la gouvernance, les droits de l'homme et le développement économique et d'inviter le Haut commissaire des Nations Unies aux droits de l'homme et l'Organisation internationale du travail à mener une mission d'enquête au Zimbabwe.

3. The Council took note of the fact that a visit to China of the UN High Commissioner of Human Rights has been scheduled for later this year and stressed the importance of close cooperation between China and the UN Human Rights mechanisms.
3. Le Conseil a pris note qu'une visite en Chine du Haut Commissaire des Nations Unies aux droits de l'homme a été programmée pour cette année et a souligné l'importance d'une coopération étroite entre la Chine et les mécanismes des Nations Unies dans le domaine des droits de l'homme.

At the same time the Union welcomes the fact that an increasing number of States work together with the EU on the basis of partnership to promote human rights and to ensure their universality.
En même temps, elle se félicite qu'un nombre croissant d'Etats coopèrent avec l'UE sur la base d'un partenariat pour promouvoir les droits de l'homme et faire en sorte qu'ils soient universels.

However, most representatives were wary about agreeing to such a possibility as they thought it would be unnecessary if suspension of rights achieved the desired effects and felt there might be a danger that this would call into question the irreversibility of membership of the Union. 34. As for the possibility of complaints by individual natural persons concerning human rights, the great majority of members of the Group makes the point that there is at present an inconsistency in the fact that, while the Member States are subject to the monitoring mechanisms of the European Convention on Human Rights, the Institutions of the Union and Community law remain exempt from such control.
Néanmoins, la plupart des membres se montrent réticents à accepter cette possibilité, qui leur paraît inutile si la suspension des droits produit les effets souhaités, ou en raison des risques que comporterait la remise en question de l'irréversibilité de l'appartenance à l'Union. 34. En ce qui concerne la possibilité que des individus introduisent des recours en matière de droits de l'homme, une large majorité des membres du Groupe souligne que l'on bute actuellement sur une incohérence : si les Etats membres sont soumis aux mécanismes de surveillance prévus par la Convention européenne des droits de l'homme, ce contrôle ne s'exerce pas sur les institutions de l'Union et la législation communautaire.
