It should be stressed that the UN Working Party on these five Cuban citizens imprisoned in the USA was of the opinion, on 27 May 2005, that the sentence passed on them 'had not been reached in a climate of objectivity and impartiality', and that the Eleventh Circuit appeal court of Atlanta decided, on 9 August 2005, unanimously to annul the sentence handed down in Miami.

I would remind the Council that the UN Working Party on these five Cuban citizens being held in the USA stated on 27 May 2005 that their trial was not carried out in a climate of ‘objectivity and impartiality’, and that the Atlanta 11 Circuit Appeals Court decided unanimously on 9 August 2005 to annul the sentence handed down in Miami.

Does the Council agree that, in these circumstances, the US Administration should immediately release the five Cuban citizens, who have already spent some seven years in prison, given that the Atlanta court has annulled the decision sentencing them? Does it not consider it unacceptable for the wives of René González and Gerardo Hernández not to be allowed to visit their husbands?
