By way of derogation from Articles 31(2), 32(4) and 37(1) of Council Regulation (EC) No 1260/1999 of 21 June 1999 laying down general provisions on the Structural Funds , sums committed for assistance co-financed by the Financial Instrument for Fisheries Guidance (FIFG), established by Council Regulation (EC) No 1263/1999 of 21 June 1999 on the Financial Instrument for Fisheries Guidance , approved by the Commission between 1 January 2000 and 31 December 2006 for which the certified statement of expenditure actually paid, the final report on implementation, comprising also the progress report referred to in Article 1(1) of Commission Regulation (EC) No 366/2001 , and the declaration referred to in Article 38(1)(f) of Regulation (EC) 1260/1999 have not been sent to the Commission within 15 months after the final date of eligibility of expenditure laid down in the decision granting a contribution from the FIFG, shall be automatically decommitted by the Commission not later than six months after that deadline, giving rise to the repayment of amounts unduly paid.
2. Par dérogation à l'article 31, paragraphe 2, à l'article 32, paragraphe 4, et à l'article 37, paragraphe 1, du règlement (CE) no 1260/1999 du Conseil du 21 juin 1999, portant dispositions générales sur les Fonds structurels , les sommes engagées pour une intervention cofinancée par l'Instrument financier d'orientation de la pêche (IFOP) établi par le règlement (CE) no 1263/1999 du Conseil du 21 juin 1999 relatif à l'instrument financier d'orientation de la pêche , approuvée par la Commission entre le 1er janvier 2000 et le 31 décembre 2006, et pour lesquelles l'état certifié des dépenses effectivement supportées, le rapport final d'exécution, y compris l'état d'avancement visé à l'article 1er, paragraphe 1, du règlement (CE) no 366/2001 de la Commission et la déclaration visée à l'article 38, paragraphe 1, point f), du règlement (CE) no 1260/1999 du Conseil, n'ont pas été transmis à la Commission dans les quinze mois après la date ultime d'éligibilité des dépenses fixée dans la décision d'octroi d'une participation de l'IFOP, sont dégagées d'office par la Commission au plus tard six mois après l'échéance en question, ce qui donne lieu au remboursement des sommes indues.

Currently, the main specialised instrument for the financing of the CFP is the Financial Instrument for Fisheries Guidance (FIFG). The FIFG forms part of the structural funds.

It should be added that the Committee on Fisheries’ recently adopted opinion for the Committee on Budgets on the 2003 Budget (PE 309.222) calls on the Commission to indicate how it intends to finance the current reform of the CFP, and also requests that this financing should not come from a reprogramming of the current FIFG. It also points out that EUR 27 million of the amount agreed between the institutions last year for the financing of the second phase of the restructuring of the fleet previously operating under the fisheries agreement with Morocco are still pending.

At present, the Commission only considers that an extra EUR 32 million could be made available if the flexibility instrument is mobilised under the 2003 Budget, but that in the years 2004, 2005 and 2006 financing would come from a reprogramming of FIFG funds.

The Member States have already programmed these funds for other uses, which means that they would be unlikely to be prepared to agree to such reprogramming, as the Commission itself recognises on page 14 of its proposal (‘The Commission will propose that aid for renewal of the fleet be strictly limited in future but it is uncertain whether the Council will agree to this amendment of FIFG rules’). Serious financing problems are therefore likely to arise with regard to this unrealistic programme which has such an insubstantial technical, scientific, legal and budgetary basis.

Therefore the Commission believes Member States should give greater priority to FIFG financing of this technology that will help to expand the sub-sector, even if it is more burdensome in terms of initial capital investment and running costs.

Their wider use should be encouraged, even though the FIFG finances the costs of quality certification, until now only three aquaculture products have been issued with a label.
