Before EU funds can be transferred, they require: (1) a Commission Decision, in order to be committed into the Budget; (2) a Framework Agreement; and (3) an annual bilateral Financing Agreement or Memorandum determining the financial commitment of the Community for the measure concerned towards the recipient country, i.e. fixing rights and obligations for both parties.
Avant que les fonds de l’UE ne puissent être transférés, plusieurs conditions sont requises : 1) une décision de la Commission afin qu’ils soient inscrits au budget, 2) un accord-cadre et 3) une convention ou un protocole annuel bilatéral de financement déterminant le montant de l’engagement financier de la Communauté en faveur du pays bénéficiaire pour la mesure considérée, c’est-à-dire stipulant les droits et les obligations des deux parties.

As a general rule, global financial commitments shall cover the total cost of the corresponding individual legal commitments concluded by the Commission up to 31 December of year N + 1, year N being the year in which the Commission's global financial commitment was adopted, subject to Article 68(3).

Community financial aid is granted with the aim of developing investment projects in TEN-T and TEN-E, of providing firm financial commitments, of mobilising institutional investors and of prompting the formation of financing partnerships between the public and private sectors.

So when it is planned to amend a Commission Decision for reasons of sound management, including financial management, or to introduce measures or instruments designed to achieve the strategic goals of the assistance and the Community policies with which that assistance must comply, the public, national and Community financial commitments have to be maintained without infringing the regulatory provisions concerning the financial management of the Structural Funds.
