In order to alleviate those problems and to speed up the implementation of operational programmes and projects, as well as to strengthen the economic recovery, it is necessary that the Member States, which have experienced or have been threatened with serious difficulties with respect to their financial stability and which have been granted financial assistance under one of the financial assistance mechanisms set out in Article 77(2) of Council Regulation (EC) No 1083/2006 of 11 July 2006 laying down general provisions on the European Regional Development Fund, the European Social Fund and the Cohesion Fund as amended by Regulation (EU) No 1311/2011 of the European Parliament and of the Council , may contribute financial resources from operational programmes to the establishment of risk-sharing instruments providing loans or guarantees or other financial facilities, in support of projects and operations provided for under an operational programme.
Pour atténuer ces problèmes et accélérer la mise en œuvre des programmes opérationnels et des projets, ainsi que pour soutenir la reprise économique, il est nécessaire que les États membres qui ont connu ou ont été menacés par de graves difficultés quant à leur stabilité financière et ont obtenu une aide financière au titre de l’un des mécanismes d’assistance financière visés à l’article 77, paragraphe 2, du règlement (CE) no 1083/2006 du Conseil du 11 juillet 2006 portant dispositions générales sur le Fonds européen de développement régional, le Fonds social européen et le Fonds de cohésion tel que modifié par le règlement (UE) no 1311/2011 du Parlement européen et du Conseil puissent consacrer des ressources financières allouées au titre de programmes opérationnels à l’établissement d’instruments de partage des risques accordant des prêts, des garanties ou d’autres facilités de financement en faveur de projets et d’actions prévus dans le cadre d’un programme opérationnel.

2. A Member State that meets one of the conditions set out in points (a), (b) and (c) of Article 77(2), may contribute a part of the overall resources distributed in accordance with Articles 19 and 20 to a risk-sharing instrument which shall be established by means of a cooperation agreement to be concluded by the Commission either with the EIB or with national or international public sector bodies or bodies governed by private law with a public service mission providing adequate guarantees as referred to in Article 54(2)(c) of Regulation (EC, Euratom) No 1605/2002, under similar terms and conditions to those applied to and by the EIB (“contracted implementing body”), to cover the provisioning and capital allocation of guarantees and loans, as well as other financial facilities, granted under the risk-sharing instrument.
2. Un État membre qui remplit l’une des conditions énoncées à l’article 77, paragraphe 2, points a), b) et c), peut consacrer une partie des ressources globales réparties conformément aux articles 19 et 20 à un instrument de partage des risques établi au moyen d’un accord de coopération conclu par la Commission, soit avec la BEI, soit avec des organismes de droit public national ou international ou des entités de droit privé investies d’une mission de service public présentant des garanties suffisantes conformément à l’article 54, paragraphe 2, point c), du règlement (CE, Euratom) no 1605/2002, selon des modalités analogues à celles appliquées à la BEI et par la BEI (ci-après dénommés “organisme d’exécution désigné”), aux fins de la constitution de provisions et de dotations en capital en faveur de garanties et de prêts et d’autres facilités de financement octroyés dans le cadre de l’instrument de partage des risques.

Risk-sharing instruments should be used for loans and guarantees as well as for other financial facilities in order to finance operations, co-financed by the European Regional Development Fund (ERDF) or the Cohesion Fund (CF), as regards investment costs which cannot be financed, as eligible expenditure pursuant to Article 55 of Regulation (EC) No 1083/2006, or pursuant to the Union rules on State aids.
Les instruments de partage des risques devraient être utilisés pour des prêts, des garanties et d’autres facilités de financement afin de financer des opérations cofinancées par le Fonds européen de développement régional (FEDER) ou le Fonds de cohésion, en ce qui concerne des coûts d’investissement ne pouvant pas être considérés comme des dépenses éligibles au titre de l’article 55 du règlement (CE) no 1083/2006 ni conformément aux règles de l’Union en matière d’aides d’État.

(13) In order to alleviate those problems and to speed up the implementation of operational programmes and projects, as well as to strengthen the economic recovery, it is necessary that the Member States which have experienced serious difficulties with respect to financial stability and which have been granted financial assistance according to one of the financial assistance mechanisms set out in Article 77(2) of Council Regulation (EC) No 1083/2006 of 11 July 2006 laying down general provisions on the European Regional Development Fund, the European Social Fund and the Cohesion Fund as amended by Regulation (EU) No 1311/2011 of the European Parliament and of the Council of 13 December 2011 amending Council Regulation (EC) No 1083/2006 as regards certain provisions relating to financial management for certain Member States experiencing or threatened with serious difficulties with respect to their financial stability, may contribute financial resources from operational programmes to the establishment of risk sharing instruments providing loans or guarantees or other financial facilities, in support of projects and operations provided for under an operational programme.
(13) Pour atténuer ces problèmes et accélérer l'exécution des programmes opérationnels et des projets, ainsi que pour soutenir la reprise économique, il est nécessaire que les États membres qui ont connu de graves difficultés quant à leur stabilité financière et ont obtenu une aide financière de l'un des mécanismes d'aide financière visés à l'article 77, paragraphe 2, du règlement (CE) n° 1083/2006 du Conseil du 11 juillet 2006 portant dispositions générales sur le Fonds européen de développement régional, le Fonds social européen et le Fonds de cohésion modifié par le règlement (UE) n° 1311/2011 du Parlement européen et du Conseil du 13 décembre 2011 modifiant le règlement du Conseil (CE) n° 1083/2006 en ce qui concerne certaines dispositions ayant trait à la gestion financière pour certains États membres qui connaissent de graves difficultés ou une menace de graves difficultés quant à leur stabilité financière puissent consacrer des ressources financières allouées au titre de programmes opérationnels à l'établissement d'instruments de partage des risques accordant des prêts, des garanties ou d'autres facilités de financement en faveur de projets et d'actions prévus dans le cadre d'un programme opérationnel.

(13) In order to alleviate those problems and to speed up the implementation of the operational programmes and projects, as well as to strengthen the economic recovery, it is appropriate that the managing authorities of the Member States having experienced serious difficulties with respect to financial stability and which have been granted financial assistance according to one of the financial assistance mechanisms set out above may contribute, temporarily and without prejudice to the 2014 to 2020 programming period, financial resources from operational programmes to the establishment of risk sharing instruments providing loans or guarantees or other financial facilities, in support of projects and operations foreseen under an operational programme.
(13) Pour atténuer ces problèmes et accélérer l'exécution des programmes opérationnels et des projets, ainsi que pour soutenir la reprise économique, il convient que les autorités de gestion des États membres qui ont connu de graves difficultés quant à leur stabilité financière et qui ont obtenu une aide financière de l'un des mécanismes d'aide financière visés ci-dessus puissent consacrer, temporairement et sans préjudice de la période de programmation 2014-2020, des ressources financières allouées au titre de programmes opérationnels à l'établissement d'instruments de partage des risques accordant des prêts, des garanties ou d'autres facilités de financement en faveur de projets et d'actions prévus dans le cadre d'un programme opérationnel.

(13) In order to alleviate those problems and to speed up the implementation of the operational programmes and projects, as well as to strengthen the economic recovery, it is appropriate that the managing authorities of the Member States having experienced serious difficulties with respect to financial stability and which have been granted financial assistance according to one of the financial assistance mechanisms set out above may contribute financial resources from operational programmes to the establishment of risk sharing instruments providing loans or guarantees or other financial facilities, in support of projects and operations foreseen under an operational programme.
(13) Pour atténuer ces problèmes et accélérer l'exécution des programmes opérationnels et des projets, ainsi que pour soutenir la reprise économique, il convient que les autorités de gestion des États membres qui ont connu de graves difficultés quant à leur stabilité financière et qui ont obtenu une aide financière de l'un des mécanismes d'aide financière visés ci-dessus puissent consacrer des ressources financières allouées au titre de programmes opérationnels à l'établissement d'instruments de partage des risques accordant des prêts, des garanties ou d'autres facilités de financement en faveur de projets et d'actions prévus dans le cadre d'un programme opérationnel.

(9) “credit line”: a financial facility allowing the beneficiary to draw down the financial contribution, which can be totally or partially reimbursable, in relation to the expenditure paid by the beneficiary and supported by receipted invoices or accounting documents of equivalent probative value’.

44. Notes that revolving financial instruments for energy efficiency measures represent an innovative way of financing climate-friendly projects; welcomes the creation of a dedicated financial facility, which could also attract private investors (in the framework of public-private partnerships (PPPs)), which would use uncommitted funds from the European Energy Programme for Recovery (EEPR) Regulation to support energy efficiency and renewable initiatives; asks the Commission to assess carefully the effectiveness of this instrument and to analyse the potential for applying a similar approach, including initiatives on energy, energy efficiency and raw materials, to future unspent funds in the EU budget;
44. constate que les instruments financiers renouvelables employés pour des mesures relatives à l'efficacité énergétique constituent une manière innovante de financer des projets respectueux du climat; préconise la création d'une facilité de financement, qui pourrait également attirer des investisseurs privés (dans le cadre des partenariats public-privé – PPP), et permettrait d'utiliser les fonds non engagés au titre du règlement établissant un programme d'aide à la relance économique (PEER) en vue de promouvoir l'efficacité énergétique et les initiatives en matière d'énergies renouvelables; demande à la Commission d'évaluer minutieusement l'efficacité de cet instrument et d'analyser les possibilités de procéder à l'avenir de façon similaire avec les crédits qui n'auront pas été dépensés dans le budget de l'Union européenne, y compris pour des initiatives concernant l'énergie, l'efficacité énergétique et les matières premières;

A dedicated financial facility (the facility) should therefore be created to use the funding under Chapter II of Regulation (EC) No 663/2009 which cannot be committed by the end of 2010.
Un instrument financier spécialisé (ci-après dénommé «instrument») devrait donc être créé afin de permettre l’utilisation des fonds au titre du chapitre II du règlement (CE) no 663/2009 qui ne peuvent être engagés d’ici la fin de 2010.

A dedicated financial facility (hereinafter "the facility") should therefore be created to use the funding under Chapter II of Regulation (EC) No 663/2009 which cannot be committed by the end of 2010.
