In accordance with Article 75 of Regulation (EC, Euratom) No 1605/2002 (hereinafter referred to as the ‘Financial Regulation’) and Article 90(1) of Regulation (EC, Euratom) No 2342/2002 (hereinafter referred to as the ‘Implementing Rules’), the commitment of expenditure from the EU budget shall be preceded by a financing decision setting out the essential elements of action involving expenditure and adopted by the institution or the authorities to which powers have been delegated by the institution.

To that end, this Commission Decision will also constitute the financing decision for the operational programmes of Belgium, Ireland, Malta, Poland, Slovenia, Hungary and United Kingdom that have not been adopted in 2007 and therefore allowing for the first budget commitment in respect of the above operational programmes before the adoption of the Decision of the Commission approving the above operational programmes.
À cette fin, la présente décision de la Commission constituera aussi la décision de financement pour les programmes opérationnels de la Belgique, de l'Irlande, de Malte, de la Pologne, de la Slovénie, de la Hongrie et du Royaume-Uni qui n'ont pas été adoptés en 2007 et permettra donc le premier engagement budgétaire pour les programmes opérationnels susmentionnés avant l'adoption de la décision de la Commission approuvant lesdits programmes.

3. Without prejudice to paragraphs 1 and 2, Regulations (EEC) No 443/92, (EC) No 2130/2001 and (EC) No 2258/96 shall remain applicable to projects and programmes for which the procedures leading to the Commission financing decision have been started but have not yet been completed at the time of entry into force of this Regulation.
3. Sans préjudice des paragraphes 1 et 2, les règlements (CEE) n° 443/92, (CE) n° 2130/2001 et (CE) n° 2258/96 demeurent applicables aux projets et programmes pour lesquels les procédures conduisant à la décision de financement de la Commission ont été engagées, mais ne sont pas encore achevées au moment de l'entrée en vigueur du présent règlement.

Regulations (EEC) No 3906/89 and (EC) No 1628/96 shall nevertheless remain applicable to projects and programmes for which the procedures leading to the Commission financing decision have been started but have not yet been completed at the time of entry into force of this Regulation.
Toutefois, les règlements (CEE) n° 3906/89 et (CE) no 1628/96 restent applicables aux projets et/ou programmes dont les procédures menant à la décision de financement de la Commission ont été entamées, mais ne sont pas encore achevées, au moment de l'entrée en vigueur du présent règlement.
