The capital injections in favour of Gdynia-Kosakowo Airport Ltd between 28 August 2007 and 17 June 2013 constitute State aid which has been unlawfully put into effect by Poland in breach of Article 108(3) of the Treaty on the Functioning of the European Union and which is incompatible with the internal market, except in so far as these capital injections were spent on investments necessary to carry out the activities that according to Decision C(2013) 4045 final must be considered as falling within the public policy remit.

Les apports en capital réalisés en faveur de Port Lotniczy Gdynia-Kosakowo sp. z o.o. entre le 28 août 2007 et le 17 juin 2013 constituent une aide d'État illégalement mise à exécution par la Pologne en violation de l'article 108, paragraphe 3, du traité sur le fonctionnement de l'Union européenne qui est incompatible avec le marché intérieur, à l'exception de la part des apports en capital affectée aux investissements nécessaires à la réalisation des activités qui, conformément à la décision C(2013) 4045 final, doivent être considérées comme relevant d'une tâche d'intérêt public.

This causes inequality of treatment and discrimination with respect of those firms and Member States which follow the notification procedures, as it is clear that an undertaking, in receipt of a non-notified aid, is receiving an illegal advantage, running from the date of the granting of the aid until the Commission's decision on it (In certain cases this financial advantage can be worth several tens of millions of Ecus). In the Boussac judgments of 1990 (Case C-301/87), the Court of Justice did not accept that the Commission had power to find an aid measure incompatible with the common market on the sole ground that it had been granted unlawfully; but it did hold that the Commission could take "measures.to counteract any infringement of Article 93(3) of the Treaty".
Ceci entraîne une inégalité de traitement, et une discrimination à l'égard de ces entreprises et ces Etats-membres qui suivent les règles procédurales de notification, puisqu'il est clair qu'une entreprise bénéficiant d'une aide non-notifiée, reçoit un avantage illégal pour la période courant à partir du moment de l'octroi de l'aide jusqu'au moment de la décision de la Commission (Cet avantage est évalué dans certains cas à plusieurs dizaines de millions d'Ecus. Dans son arrêts Boussac de 1990 (Cas C-301/87), même si la Cour n'a pas reconnu à la Commission la possibilité de déclarer une aide incompatible du simple fait de son illégalité, elle n'en a pas moins estimé que "des mesures puissent être prises en vue de contrecarrer toute violation des règles de l'article 93, paragraphe 3, du traité".
