In that context, the Juzgado de lo Mercantil No 1 de Pontevedra (Commercial Court No 1 of Pontevedra, Spain), to which the matter was referred, asked the Court of Justice to clarify whether this case can be considered as a flight ‘cancellation’. In addition, the Spanish court seeks to ascertain whether the ‘further compensation’ that passengers can claim covers all types of damage – including non-material damage – and whether that compensation also refers to costs incurred by passengers due to the failure of the air carrier to fulfil its obligations to assist and take care.
Dans ce contexte, le Juzgado de lo Mercantil nº 1 de Pontevedra (tribunal de commerce de Pontevedra, Espagne), saisi de l’affaire, demande à la Cour de justice de clarifier si le cas d’espèce peut être considéré comme une « annulation » de vol. De plus, la juridiction espagnole cherche à savoir si l’« indemnisation complémentaire » que les passagers peuvent réclamer couvre tout type de préjudice – y compris moral – et si cette indemnisation vise également les dépenses que les passagers ont dû supporter en raison du manquement du transporteur aérien aux obligations d’assistance et de prise en charge qui lui incombent.
